RI NURSING HOME ABUSE LAWYER – d’OLIVEIRA & ASSOCIATES
Nursing homes and extended care facilities are expected to shelter and take care of our elderly loved ones. Recent studies show, however, that residents suffer from different types of abuse and neglect every day. In fact, 90% of nursing homes are understaffed and 1 of every 3 nursing homes has been cited for abuse violations. A more disturbing problem is that only roughly 20% of incidents get reported, and the problem continues to rise over the years. There are many ways that an individual in a nursing home can be exposed to risks of death. Accidents in nursing homes are often very easily preventable. Unfortunately, nursing care facilities that are chronically understaffed run the risk of making a mistake that can cost the life of your loved one.

February 9, 2012–Daly City, CA– The California Department of Public Health cited a local resident care facility, Seton Medical Center, with the maximum allowable fine by law after an investigation uncovered inadequate care in the wrongful death of a resident. The patient, who was not identified in the report, was said to have died after proper respiratory care was withheld by the staff at the Medical Center.

Public health officials announced Tuesday Seton Medical Center, 1900 Sullivan Avenue, received a $100,000 fine after an investigation into the death of a resident. The officials found that the staff had been negligent in providing proper care, and cited the facility with a class “AA” citation, which carries the maximum financial penalty.

I want to extend my sincere and heartfelt condolences to the family of the victim in this case for the loss of their loved one.

Nursing Home Accident Statistics

Deaths in nursing homes due to negligence are, unfortunately, not as uncommon as many would believe. Overworked and underpaid staff lead to neglect of necessary care. In 2005, 91.7 percent of all nursing homes in the United States were cited by health inspectors for some form of violation. In 1999, 5,000 deaths nationwide were attributed to poor nursing home care. Experts estimate that one in three nursing home residents will experience some form of neglect or abuse during their stay.

The Following article on California Injury Blog is a guest post from KeepingUsSafe.org.

Last fall, I received a telephone call from a very troubled and frustrated young lady (“Mary”), pleading that I provide her with some resolution to what has developed into a family battle.

The battle involves a family debate over the driving abilities of their 83-year-old father. Mary says her family has become completely divided on the issue, some thinking her father is fine to continue driving, and some afraid that he is going to cause a terrible accident if he doesn’t stop driving immediately.

California law requires that all drivers be insured. For many however, the cost of insurance is too high to maintain and many low-income drivers simply go without it to the detriment of everyone. Assemblyman Dave Jones’ bill, SB 171, was set to expire but on September 28, 2010, Schwarzenegger signed a five year extension. SB 171 is the first of its kind in the nation and offers low cost basic insurance to qualifying, low-income drivers with good records.

Under SB 171, all insurers in the state of California are required to sell a certain number of low-cost policies to qualifying drivers. Insurance companies and agents are required by law to inform prospective policyholders about the program. With poverty levels rising this program is more important than ever and insurance companies and agents must be held accountable to inform the public.
