Two Pedestrians Injured in DUI Collision

By

Christine Sanchez and Darlene Delira, both 25, were injured in a Ventura car accident, which police say, was caused by a drunk driver. According to a news report in The Ventura County Star, the injury accident occurred as the pedestrians were walking in a marked crosswalk on Main Street in Ventura early morning on December 24, 2010. The two women were crossing the road when they were struck by a southbound vehicle driven by Brendan Conaty, 26. The two victims were transported to an area hospital with injuries, but have been listed in stable condition. Conaty has been arrested on suspicion of felony DUI.

My thoughts and prayers are with the two victims of this serious injury DUI collision. I wish them both the very best for a complete and speedy recovery from their injuries.

Ventura Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), two people were killed and 47 were injured in Ventura pedestrian accidents. During that same year, there were eight fatalities and 224 injuries reported as a result of pedestrian accidents in Ventura County as a whole.

California Drunk Driving Laws

Not only does it appear, from this news account, that the driver violated California Vehicle Code Section 21950 by failing to yield right-of-way to pedestrians walking in a marked crosswalk, but also that Conaty was under the influence of alcohol. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” It is illegal to operate a motor vehicle with a blood alcohol concentration of 0.08 percent or higher.

Liability Issues

Drunk drivers who cause injury car accidents can face criminal charges. They can also be held financially responsible for the injuries, damages and losses caused. Injured victims can seek compensation for medical expenses, loss of earnings, cost of hospitalization, rehabilitation and other related damages. An experienced Ventura personal injury lawyer will be able to better advise injured victims in such cases about their legal rights and options. A knowledgeable car accident attorney should also inform car accident victims about how their own car insurance policy might apply to an incident where the at-fault motorist is uninsured or underinsured. The ban on online gambling is much like the war on drugs. If marijuana was legalized in the USA crimes related to it would almost go away completely, because it would be sold in stores and it would be controlled, another advantage would be that people would no longer be going to jail for marijuana related charges, this means thousands of less people getting arrested and going to jail every year, which would save us tax money that could be better spent.
