San Bernardino Car Accident Fatally Injures Pedestrian

Johnny Contreras, 52, was killed in a San Bernardino car accident when a car struck him as he crossed the street. According to a news report in The Press-Enterprise, the fatal pedestrian accident occurred at the intersection of North Mt. Vernon Avenue and West Olive Street in San Bernardino the evening of February 18, 2011. Contreras was crossing the street when the car hit him. He died from his injuries in a nearby hospital. An investigation is ongoing.

My deepest condolences go out to the family and friends of Johnny Contreras following this tragic car accident. My thoughts and prayers are with them during this difficult time.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), three people were killed and 80 were injured in San Bernardino pedestrian accidents. During that same year, there were 39 fatalities and 432 injuries reported as a result of San Bernardino County pedestrian accidents.

Laws Relating to Pedestrians

It is unclear from the report how this accident occurred. Under California law, motorists are required to yield right-of-way to pedestrians walking in marked or unmarked crosswalks. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Liability Issues

If the driver in this case is determined to have been at fault, then he or she can be held accountable for the victim’s wrongful death. Families of deceased car accident victims, in cases where negligence or wrongdoing was involved, can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced San Bernardino personal injury lawyer will better advise families in such cases about their legal rights and options.

One response to “San Bernardino Car Accident Fatally Injures Pedestrian”

  1. Ryan Bradley says:

As a Missouri personal injury lawyer, I have dealt with hundreds of pedesrian accident cases, and it seems like they are certainly on the rise. It would be interesting if you could search SWITRS for historical data on pedestrian crashes and see if my theory is corret. I firmly believe the likely increas is from drivers using cell phones. Here in Missouri, you can still operate a vehicle while talking on a cell phone- even without a hands free device!
