Anaheim Car Accident Proves Fatal for Woman

By

A woman was fatally injured in an Anaheim car accident that involved three vehicles the morning of July 15, 2010. According to a news report in The Orange County Register, the fatal car crash occurred at the intersection of East Miraloma Avenue and North Blue Gum Street and involved a 2005 Nissan sedan, a 1997 Chevy pickup truck and a black Honda Civic.

Anaheim police officials say the Nissan was headed north on Blue Gum and the truck was going east on Miraloma. The Civic was westbound and stopped on Miraloma. The Nissan was struck by the pickup truck as it entered the intersection. The Honda was also hit. The driver of the pickup sustained minor injuries and the driver of the Civic was uninjured, but the female driver of the Nissan sustained fatal injuries. Anyone who saw this incident is asked to call Anaheim police at 714-765-1861.

I offer my deepest condolences to the family and friends of this deceased victim for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.

Car Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 21 fatalities and 2,018 injuries involving car accidents in Anaheim. In Orange County as a whole, 152 deaths and 13,414 injuries were reported as a result of car accidents during the same year.

Law and Liability Issues

If the details of this news report are accurate, this appears to be a right-of-way issue. The main question is: Who had the right-of-way at this intersection. According to California Vehicle Code section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”

In this particular case if the driver of the driver of the pickup truck was at fault, he could be held liable for the wrongful death of the Nissan’s driver. I trust officials are looking into whether one of the drivers ran a red light or was distracted, impaired or otherwise negligent. Where negligence or wrongdoing is involved, families of deceased accident victims can file a wrongful death claim seeking compensation to cover medical and funeral expenses, lost future earnings, loss of love and companionship, and other related damages.
