Causes and Liability Issues
This news article does not clearly state how or why this accident occurred. We do not know where the bicyclist was riding at the time. Was he in a crosswalk or riding along the side of the road? Was he riding the bike or walking his bike? Did one of the parties involved fail to yield right-of-way? Was the driver of the streetcar under the influence or distracted at the time of the accident? I trust the results of this investigation will shed more light on what occurred here.
If the driver of the streetcar is determined to have been at fault, he as well as the Muni could be held liable for the resulting accident and injuries. An experienced San Francisco personal injury lawyer will be able to advise victims in such cases about their legal rights and options.
