Orange County Motorcycle Accident Results in Serious Injuries

By

A man suffered severe injuries in an Orange County car accident involving a motorcycle and a Toyota Highlander, the afternoon of June 21, 2011. According to The Orange County Register, the motorcycle crash occurred at Maple and First streets in Santa Ana. Officials say that it is unclear which motorist had the right-of-way when the Highlander struck the motorcycle at the T intersection. The male motorcyclist sustained life-threatening injuries in the crash. No arrests have been made and an investigation is ongoing.

My thoughts and prayers are with the motorcyclist who has been critically injured. I wish him the very best for a complete and speedy recovery.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), four people were killed and 70 were injured in Santa Ana motorcycle accidents. During that same year, 35 fatalities and 801 injuries occurred as a result of motorcycle accidents in Orange County.

Right-of-Way Issues

Based on this news report, authorities are trying to determine which motorist had the right-of-way at the time of the crash. The driver of the Highlander was traveling northbound on Maple Street and the motorcyclist was eastbound on First Street.
According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” It is also possible that the motorcyclist was hit as the driver of the Highlander was making a left turn.

Liability Issues

I trust officials are also looking into whether distraction, inattention, or impairment was a factor in this crash. If the driver of the Highlander is determined to have been at fault, he or she could be held liable for the resulting injuries. Injured victims can seek compensation in such cases for all medical expenses, loss of earnings, cost of hospitalization, rehabilitation and other related damages.
