Man Killed in Los Angeles Bicycle Accident

A 71-year-old man was killed in a bicycle accident in Ladera Heights, which is an unincorporated area of Los Angeles County.

According to a report on My News LA, the fatal crash occurred early on the morning of Sept. 18 at the intersection of Centinela Avenue and Alvern Street.

DUI Investigation

California Highway Patrol officials said a 2019 Toyota Camry driven by 27-year-old Michael Tesfai was westbound on Centinela Avenue in the number two lane when the man on the Cannondale bicycle south on Alvern Street made a right onto westbound Centinela and was struck by the car.

The bicyclist was pronounced dead at the scene by Los Angeles County paramedics. Tesfai was arrested on suspicion of DUI and booked at the LA County jail after being treated for abrasions to his eyes and being medically cleared, officials said.

We offer our deepest condolences to the family members of the deceased bicyclist for their tragic loss. Please keep them in your thoughts and prayers.

Laws and Liability Issues

Based on this news report, it appears that the driver of the Toyota that struck and fatally wounded the bicyclist may have been under the influence of alcohol and/or drugs at the time of the collision. Under California Vehicle Code 23152 (a), it is illegal to operate a vehicle under the influence of alcohol and/or drugs. A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).

If you have been injured by a drunk driver or if you have lost a loved one because of a DUI driver, it is important to understand that you have legal rights. In addition to facing criminal charges and penalties, DUI drivers can also be held civilly liable for the injuries, damages, and losses they cause.

Families of deceased victims in such cases can file a wrongful death lawsuit seeking compensation for damages including medical expenses, funeral costs, lost future income, pain and suffering, and loss of love, care, and companionship. Families of victims would also be well advised to contact an experienced Los Angeles DUI victims’ lawyer who will stay abreast of the official investigation and make sure their legal rights and best interests are protected.
