DUI Hit and Run
Based on this news report, it appears that the driver in this case was not only operating a vehicle while under the influence but also fled the scene of the pedestrian accident, leaving the wounded victim lying in the street, exposed to further danger. California Vehicle Code Section 23152 (a) prohibits motorists from driving a vehicle while under the influence of alcohol or drugs.
In addition, the law also states it is illegal to leave the scene of an injury or fatal crash. This is a felony crime in California regardless of who was at fault for the accident. Drivers have the responsibility to stop immediately, wait for the authorities to arrive, exchange information with other concerned parties, and render aid to the injured victims. This may be something as simple as calling 911, ensuring that victims receive medical attention right away. In many cases, such prompt attention could make the difference between life and death.
