By

Long Kim Ta of Santa Ana was killed in a pedestrian accident in Fountain Valley near Mile Square Park after a vehicle ran a red light and struck Ta as he crossed the street.

According to an ABC7 news report, the fatal pedestrian accident occurred at the intersection of Edinger Avenue and Ward Street. Police said the driver struck Ta and took off.

Ongoing Investigation

Ta’s family members said the incident happened early morning on Sept. 11, just as Ta was finishing up his run at Mile Square Park. Police have reviewed the surveillance video and have marked a dark-colored vehicle as a vehicle of interest. It is possibly a 1991 to 1995 Chrysler or Dodge minivan, which may have front-end damage. Anyone with information is urged to contact the Fountain Valley Police Department Traffic Bureau at 714-593-4481. The investigation is ongoing.

We offer our deepest condolences to the family members of Long Kim Ta for their terrible loss. Please keep them in your thoughts and prayers.

Laws and Liability Issues

Based on this news report, it appears that the driver of the vehicle that struck Ta ran a red light and hit the pedestrian who was crossing legally at the intersection. The driver then left the scene. All these are serious violations of the law.

California Vehicle Code section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.” Also, California Vehicle Code Section 20001 (a) states drivers must stop and remain at the scene of a crash where someone is injured or killed. Motorists also have a duty to exchange pertinent information and most importantly, render aid to the injured victim.

In such cases, it would be in the best interest of victims’ families to seek the counsel and guidance of an experienced Orange County hit and run lawyer who has experience protecting the rights of victims and families in such situations. In such cases, families of deceased victims struggle not just emotionally as they grieve the sudden and tragic loss of a loved one, but also financially as they work to deal with unexpected expenses. A knowledgeable lawyer will be able to help them during these challenging times.
