Dalia Albert, 26, was seriously injured in an Orange County truck accident after her bicycle crashed into a semi-trailer the afternoon of November 19, 2009. According to a news report in The Orange County Register, the big rig, driven by 29-year-old Juan Soto, was in the right lane of eastbound Edinger Avenue in Huntington Beach. He was apparently waiting at the light to turn right on Gothard Street. Albert was riding her bike east in the bike lane when the light turned green. Albert kept riding as the big rig turned right in front of her, Huntington Beach police said. She sustained several cuts and broken bones in her legs, but is said to be in stable condition. Police are still investigating this injury collision. Anyone who saw this accident is asked to call Huntington Beach Police at 714-536-5666.
My heart goes out to this young bicyclist, Dalia Albert, who has indeed suffered serious injuries in this crash. I hope she recovers quickly and completely from her severe leg injuries. I’m relieved that she did not sustain catastrophic injuries in this crash. Please keep this young woman in your prayers.
Orange County Bicycle Accident Statistics
According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there was one fatality and 105 injuries involving California bicycle accidents in Huntington Beach. In Orange County as a whole, 16 deaths and 1,020 injuries were reported as a result of bicycle accidents in 2007.
Bicycle riders are subject to the same traffic laws as other drivers. In this case, I trust the investigation is focusing on who had the right-of-way at the time of the collision. If the big rig driver is found to be at fault, both he and his employer — the trucking company — can be held liable for Albert’s injuries. In such cases, injured victims could seek compensation to cover medical expenses, lost wages, cost of hospitalization, physical therapy and other related damages.
An Experienced Personal Injury Lawyer Can Help
Albert would be well-advised to consult with a reputed personal injury attorney in Orange County, who has successfully represented bicycle accident victims. A skilled car accident lawyer will also look into whether there was a dangerous condition on this roadway that may have caused or contributed to this accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Please remember that any claim against a governmental agency in California must be properly filed within 180 days of the accident or injury.
