Laws and Liability Issues
Based on this news report, it appears that one or more drivers involved in this deadly collision may have been operating while under the influence of alcohol and/or drugs. It is illegal to operate a motor vehicle under the influence of alcohol and/or drugs under California Vehicle Code Section 23152 (a). A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).
In addition to facing criminal charges and penalties, drivers who operate under the influence of alcohol and/or drugs can also be held financially responsible for the injuries, damages, and losses caused.
