Cydil Kohlmeyer, 35, was killed in a San Diego car accident after she was struck by a suspected drunk driver, while walking on a street, 10news reports. Kohlmeyer was walking in the 1200 block of Pepper Drive the night of November 21, 2009 when an eastbound pickup truck driven by 51-year-old Deborah Felix, went off the roadway and hit her.
The out-of-control pickup truck then continued on and plowed into several mailboxes, a parked truck, a fence, crossed two front yards and crashed into a house. Felix tried to run away from the scene, but several neighbors caught and held her at the scene, California Highway Patrol officials said. Felix was taken to a hospital and then arrested on suspicion of felony drunk driving and vehicular manslaughter. Kohlmeyer was transported to a local hospital where she died during surgery, the San Diego County Coroner’s office reported.
My heart goes out to everybody who knew and loved Cydil Kohlmeyer. I offer my deepest condolences to her family and friends for their shocking loss. What a devastating blow for them! Kohlmeyer’s loved ones will certainly be in my prayers.
San Diego Pedestrian Accidents
According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were seven fatalities and 79 injuries involving pedestrian accidents in the unincorporated areas of San Diego County. In San Diego County as a whole, 51 deaths and 1,068 injuries were reported in 2007, as a result of pedestrian accidents. Countywide, 116 deaths and 2,068 injuries were attributed to alcohol-related car accidents during that same year.
If this news report is accurate, I trust the suspected drunk driver, Deborah Felix, will also be charged with felony hit-and-run for attempting to run away from the scene of this horrific crash. If she is found guilty on all counts, she should face the maximum punishment for the extensive damage and grief she has caused to the Kohlmeyer family.
Serious Violations of California Driving Laws
Felix broke several laws here. She was apparently driving under the influence, which is a violation of California Vehicle Code 23152. She attempted to flee the scene of the crash, a violation of California Vehicle Code 20001.
Kohlmeyer’s family would be well-advised to retain the services of an experienced San Diego personal injury lawyer who will better inform them about their legal rights and options. Where negligence or wrongdoing is involved, families of deceased car accident victims are able to file a wrongful death claim seeking compensation to cover medical/funeral expenses, loss of earnings and other damages. A skilled car accident lawyer will also be able to advise Kohlmeyer’s family about how their car insurance policy will apply to an accident involving an uninsured or underinsured driver.
