Man Killed in San Francisco Area Truck Accident

Jose Villaneuva, 26, was killed in a San Francisco truck accident after a dump truck backed over him, according to a Bay City News report. Villaneuva was apparently helping a Redwood City dump truck back up near Marine Parkway and Twin Dolphin Drive the afternoon of December 22, 2009, when it struck him. Villaneuva was taken to a local hospital where he was pronounced dead. Police are still investigating the cause of this fatal accident. Anyone who witnessed this accident or has more information is asked to call Redwood City police at 650-780-7100.

I offer my deepest sympathies to the family of Jose Villaneuva for their tragic and heartbreaking loss. My heart goes out to everyone who knew and loved this man. Please keep them in your prayers.

Traffic Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS) there were a total of four fatalities and 425 injuries involving traffic accidents in Redwood City, California. In San Mateo County as a whole, 27 deaths and 2,762 injuries were reported as a result of traffic accidents in 2007.

Is this a Job Injury?

Based on this news report, it is not clear exactly how or why this fatal accident occurred. We do not know whether Jose Villaneuva was a passer-by who was helping the dump truck back up or a city employee who was on the job. If he was employed by the city then Villaneuva’s family would be entitled to receive California worker’s compensation benefits. They might also want to look into filing a third-party claim. Such claims are usually filed in serious job injury cases, where the injuries were caused by the negligence of a third party (one other than an employer) such as a contractor, sub-contractor or manufacturer of a defective product.

If Villaneuva was not an employee, but just a passer-by who was asked by the dump truck driver to help out, then the city could be held liable for the accident and resulting fatal injuries. California Government Code requires that any claim against a governmental agency be filed within 180 days of the accident or injury.
