San Diego County Motorcycle Accident Proves Fatal

By

Michael Ennis, 63, was killed in a San Diego car accident when his Kawasaki motorcycle hit a Jeep Cherokee the morning of March 10, 2011. According to a news report in The San Diego Union-Tribune, the fatal motorcycle accident occurred on Campo Road in unincorporated Casa de Oro near La Mesa. Police say 48-year-old Wendy Antisdel, the driver of the Jeep, made a left turn into the path of the Kawasaki. The two vehicles collided and Ennis was thrown from his motorcycle. He was taken to an area hospital and underwent surgery, but died from his injuries a few hours after the accident. An investigation is ongoing.

My deepest condolences go out to the family and friends of Michael Ennis for their tragic loss. My thoughts and prayers are with them following this fatal injury car accident.

San Diego Motorcycle Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 27 people were killed and 324 were injured due to motorcycle accidents in the unincorporated areas of San Diego County. During that same year, there were 51 fatalities and 1,081 injuries reported involving motorcycle accidents in San Diego County as a whole.

Right-of-Way Issues

It appears based on this news account that the driver of the Jeep Cherokee made a left turn in front of the motorcycle. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Liability Issues

I trust officials are also investigating whether impairment, distracted driving, or any other form of negligence caused this fatal motorcycle accident. If the other driver is determined to have been at fault, she could be held liable for Ennis’ wrongful death. Families of deceased car accident victims can seek compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced San Diego personal injury lawyer will be able to better advise victims and their families about their legal rights and options.
