Fatal San Bernardino DUI Car Accident

Ruben C. Vasquez, 20, was killed in a San Bernardino car accident on the 60 Freeway after a suspected drunk driver rear-ended him, the Inland Valley Daily Bulletin reports. California Highway Patrol officials say Vasquez was driving a 2006 Chevy Cobalt on the freeway, in Chino, the morning of June 20, 2010, when his vehicle was struck from behind by 33-year-old Daniel Rosas. Two minutes later, another suspected drunk driver crashed into Rosas’ 2007 Nissan Frontier while he was still sitting in the car. That driver Alex Ruiz Leal, 23, as well as Rosas were arrested on suspicion of DUI. Vasquez was transported to a local hospital where he died from injuries sustained in the crash.

DUI Statistics

According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but 45 injuries involving DUI collisions in Chino. In San Bernardino County as a whole, 94 people died and 1,052 suffered injuries as a result of alcohol-related car accidents during the same year.

Drunk Driving Law

It is illegal under California law to drive with a blood alcohol level of 0.08 percent or higher. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” In such cases, where the DUI accident results in death, the driver could also face vehicular manslaughter charges under California Penal Code section 191.5 (a).

This particular car accident involved not one, but two suspected drunk drivers. If Rosas is determined to have been at fault, he could not only face criminal charges, but also be held financially responsible for the wrongful death of Ruben Vasquez.
