Man Killed in Sacramento Car Accident

By

David Wayne Plumb, 30, was killed in a Sacramento car accident the night of January 29, 2011. According to a news report in The Sacramento Bee, the fatal car accident occurred on Highway 99 south of Laguna Boulevard in Elk Grove. A vehicle entering the freeway lost control and struck Plumb’s Dodge minivan, which carried a total of seven occupants. The minivan rolled on the highway and Plumb was ejected from the vehicle. Plumb died from his injuries. The other six occupants suffered minor to moderate injuries in the accident. An investigation is ongoing.

My deepest sympathies go out to the family and friends of David Wayne Plumb following this tragic accident. My thoughts and prayers are also with the many injured victims of this accident.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), four people were killed and 366 were injured in Elk Grove car accidents. During the same year, 84 fatalities and 7,874 injuries occurred involving Sacramento County car accidents.

What Caused This Fatal Accident?

CHP officials are no doubt investigating why the driver of the first vehicle lost control and crashed into the minivan. It would be important in this case to determine if the driver of the vehicle that was entering the freeway was speeding or driving recklessly or distracted at the time. Official have stated that drugs or alcohol were not factors. Was the roadway slick or did another dangerous condition exist at that location? Was there an auto defect or mechanical malfunction that led to this fatal injury accident? These are just some of the questions that must be answered in order to establish what exactly happened in this incident.

The Plumb family has been dealt a tremendous blow in this rollover accident. If I were a family member of the deceased victim here, I would definitely want to know whether there were any design defects or flaws involving the seatbelt, which contributed to the victim’s ejection from the minivan. In my experience, inherent vehicle defects are often contributory factors, often adding to the severity of the victims’ injuries in these types of rollover accidents.

Liability Issues

If the driver of the other vehicle is determined to have caused this car accident, then he or she could be held liable for Plumb’s wrongful death and the other injuries to the other passengers. Families of deceased car accident victims, in cases where negligence is involved, may file a wrongful death claim. Such claims seek compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced Sacramento personal injury lawyer will better advise injured victims or their families about their legal rights and options.
