Tung Hoang, 34, was critically injured in a Garden Grove car accident after he was hit by a car while trying to cross the street. According to a news report in the Garden Grove Journal, Hoang was injured in the collision the night of January 22, 2010 while walking across Ward Street near Bolsa Avenue. He was transported with critical injuries to an area hospital. The driver of the vehicle that struck Hoang was identified as 21-year-old Nguyen Vu. He was apparently going north on Ward when the injury accident occurred. Police have not ruled out the involvement of alcohol or drugs. Vu has not been cited or arrested pending a police investigation. Anyone who witnessed this major injury collision is asked to call Garden Grove police at 714-741-5823.
My heart goes out to Tung Hoang, who has apparently sustained critical injuries in this pedestrian accident. I hope and pray that he makes it through his injuries and has a speedy recovery. Hoang and his family will certainly be in my prayers.
Pedestrian Accident Statistics
According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but 49 injuries involving pedestrian accidents in the city of Garden Grove. In Orange County as a whole, 41 fatalities and 726 injuries were reported as a result of pedestrian accidents in 2007.
Accident Causes
There are still several questions here. Was Hoang crossing the street in a marked/unmarked crosswalk or at an intersection? If that was the case, then the driver could be held responsible for failing to yield right-of-way to the pedestrian. If I were a member of Hoang’s family, I would definitely want to find out whether there was any negligence on the motorist’s part. Was he driving under the influence of alcohol or drugs? Was he distracted? Was he speeding, driving recklessly or negligently at the time of the collision? If the driver is found to be at fault for this accident he could be held liable for Hoang’s serious injuries.
Liability Issues Involved
An experienced Orange County personal injury lawyer will stay on top of the accident investigation and make sure the victim’s legal rights and best interests are protected. A skilled car accident lawyer will also determine whether a dangerous condition on the roadway led to this accident. If that was the case, the governmental entity responsible for maintaining that roadway can also be held liable. California Governmental Code 911.2 requires that claims against governmental agencies be filed within six months of the accident or injury.
