Motorcyclist Seriously Injured in San Diego Car Accident

A 39-year-old man was injured in a San Diego car accident when a Nissan Versa pulled ahead of his motorcycle. According to The San Diego Union-Tribune, the motorcycle accident occurred on Linda Vista Road in Linda Vista, the afternoon of June 3, 2011. The motorcyclist was travelling south on Linda Vista, near Ulric Street, when the 50-year-old male driver of the Nissan pulled out of a restaurant parking lot and made an unsafe lane change. The motorcyclist braked hard in an attempt to avoid a collision and was ejected. The victim flipped over the motorcycle’s handlebars and hit the back of the car, suffering a lower leg and wrist injury. He was transported to an area hospital. It is not clear if the driver of the car will be cited for making an unsafe lane change.

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 16 people were killed and 355 were injured in San Diego motorcycle accidents. Violation of Traffic Laws

This news report does not specify if the driver violated California Vehicle Code Section 21804 by entering traffic lanes without properly yielding right-of-way to the oncoming vehicle. Drivers are required to yield right-of-way before pulling out of a private driveway, onto a public roadway. The article does, however, state that the crash occurred when the motorist made an unsafe lane change. California Vehicle Code Section 21658 (a) states that whenever a roadway has been divided into two or more clearly marked lanes for traffic in one direction the vehicle “shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.”
