Injuries Reported in San Diego School Bus Accident

By

A school bus accident on the Interstate 805 in San Diego resulted in injuries for at least one person, 10news report. California Highway Patrol officials said the injury crash occurred near State Route 163 the morning of September 28, 2010, when the school bus was struck by another vehicle from behind. It appears that the school bus driver may have been injured because there was extensive damage to the front of the bus, which had also struck a tree. There were no students in the bus at the time. Officials are investigating the cause of the accident.

I hope the victim in this case has not sustained catastrophic injuries. I wish the victim the very best for a quick and full recovery. It is indeed fortunate that there were no students on the bus. This accident could certainly have been a lot worse.

Car Accidents

There were 246 deaths and 13,527 injuries involving car accidents in San Diego County in 2008, according to CHP’s Statewide Integrated Traffic Records System (SWITRS). Also, 81 fatalities and 6,123 injuries were reported during the same year as a result of San Diego car accidents.

Causes and Liability Issues

There are very few instances when the driver who rear-ended another would not be found at-fault or liable for the crash. It is not clear from the news account what caused the vehicle to rear-end the school bus. Was the driver of the car impaired, distracted, or otherwise negligent? Was speed a factor?

California Vehicle Code Section 22350 (Basic Speed Law) states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

If the driver of the car is determined to have been at fault here, then he or she could be held liable for the other victim’s injuries. An experienced San Diego personal injury lawyer will be able to analyze all aspects of the crash and hold the negligent parties liable.
