Fatal San Diego Pedestrian Accident

By

A woman who was killed in a pedestrian accident in National City has been identified as 53-year-old Maria Trinidad Anguiano Galindo. The San Diego Union-Tribune reports that Galindo was walking in a marked crosswalk at the intersection of D Avenue and East 18th Street the morning of November 5, 2010, when she was struck by a pickup truck that was turning left. Galindo sustained fatal injuries. The driver has not been cited or arrested pending an official investigation.

My heartfelt sympathies go out to everyone who knew and loved Maria Trinidad Anguiano Galindo. This grieving family will be in my prayers.

Car Accidents

There were three deaths and 232 injuries involving San Diego car accidents in 2008, according to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS). In San Diego County as a whole, 246 people died and 13,527 were injured as a result of car accidents in 2008.

Laws and Liability Issues

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” Based on this news report, the driver of the pickup told officials that he could not see the woman in the crosswalk because the sun was in his eyes. I trust officials are looking into whether the driver was negligent here in any way.

If the driver of the pickup truck is determined to have been at fault, he could be held liable for Galindo’s wrongful death. A skilled San Diego personal injury lawyer will also be able to determine whether a dangerous or defective roadway condition may have caused or contributed to the incident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Under California Government Code Section 911.2, any personal injury or wrongful death claim against a public entity must be properly filed within 180 days of the accident or injury.
