Pedestrian Accident in Orange County Proves Fatal

A man who was killed in a pedestrian accident in Westminster has been identified as 32-year-old Daniel Villa. The Orange County Register reports that the fatal car versus pedestrian accident happened at the intersection of Goldenwest and Maple streets the night of October 24, 2010. Villa died at the scene. Officials are still investigating this incident.

There were four fatalities and 467 injuries involving car accidents in Westminster, according to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS). Also, during the same year, 152 people died and 13,414 were injured as a result of Orange County car accidents.

Crosswalk Law

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Fault and Liability

In this particular case, it is not clear if Villa was in a marked or unmarked crosswalk. There are also several unanswered questions. Was the motorist intoxicated or distracted at the time? Was speed a factor? Was there a dangerous condition at the intersection, which may have caused or contributed to the pedestrian accident? I trust officials are looking into these and other issues in order to determine fault and liability in this case.
