DUI Suspected in Fatal Upland Crash

By

The driver of a vehicle was killed in a car crash in Upland on the night of May 3, which authorities believe was caused by a suspected DUI driver.

According to a news report in The Press-Enterprise, the fatal crash occurred on Campus Avenue just south of Foothill Boulevard. Police said the suspect, 29-year-old Marcos Enriquez, was speeding on Campus Avenue when he hit another car.

Ongoing DUI Investigation

The driver of the other vehicle died as a result of that collision, officials said. Enriquez was arrested on suspicion of vehicular manslaughter while intoxicated and DUI, according to police. The victim’s name was not released, and no further information was available. The investigation into this fatal DUI crash is ongoing.

We offer our deepest condolences to the family of this deceased DUI collision. They will be in our thoughts and prayers.

California Basic Speed and DUI Laws

Based on this news report, it appears that the driver was intoxicated and driving at an excessive rate of speed when he collided with the other vehicle and caused the fatal crash. California Vehicle Code Section 22350 (Basic Speed Law) states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

California Vehicle Code 23152 (a) states it is illegal to operate a motor vehicle while under the influence of alcohol and/or drugs. A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).

Justice for Victims and Families

In such cases, in addition to facing criminal charges and penalties, DUI drivers can also be held financially responsible for the injuries, damages, and losses they cause. Families of deceased victims can file a wrongful death lawsuit against the at-fault parties seeking compensation for medical expenses, funeral costs, lost future income, pain and suffering, and loss of love, care, and companionship. An experienced San Bernardino DUI victims’ lawyer will be able to advise victims and their families regarding their legal rights and options.
