Bicyclist Killed in DUI Crash

By

Abe Mendibles, 41, was killed in a Las Vegas bicycle accident after officials said he was struck by a DUI driver.

According to a news report in the Las Vegas Review-Journal, the fatal bicycle accident occurred in the 3100 block of Las Vegas Boulevard North near North Pecos Road. Metropolitan Police Department officials said Chevrolet Cobalt that was northbound on Las Vegas Boulevard went off the roadway.

DUI Investigation

The car struck Mendibles as he was riding his bike on the east sidewalk. He was pronounced dead at the scene. The driver, 26-year-old Raymond Perez-Hernandez, was booked on suspicion of driving under the influence resulting in death, reckless driving, and driving with a suspended license. The investigation is ongoing.

We offer our deepest condolences to the family members of Abe Mendibles for their tremendous loss. Please keep them in your thoughts and prayers.

Laws and Liability Issues

Based on this news report, it appears that the driver who lost control of the vehicle and struck the bicyclist on the sidewalk was driving while under the influence. Officials also say he was driving recklessly and with a suspended license. Under Nevada law, it is illegal to operate a vehicle while under the influence of alcohol and/or drugs.

In cases where negligence or wrongdoing is apparent, injured accident victims may be able to file a personal injury lawsuit against the at-fault parties seeking compensation for damages such as medical expenses, lost income, hospitalization, cost of rehabilitation, permanent injuries, disabilities, and past and future pain and suffering.

Families of deceased victims may file a wrongful death lawsuit seeking compensation for medical expenses, funeral costs, lost future income, pain and suffering, and loss of love, care, and companionship. In some cases, other parties may also be held liable. For example, if the at-fault driver was on the job at the time, his or her employer may also be held accountable.

In such cases, families of deceased victims would be well advised to contact an experienced Las Vegas DUI victims’ lawyer who will stay abreast of the official investigation and help ensure that their legal rights and best interests are protected.
