Pedestrian Killed in Orange County Car Accident

By

Kelly Jay Henningsgaard, 56, was killed in an Orange County car accident when he was struck by at least two vehicles. According to an ABC news report, the fatal pedestrian accident occurred on Harbor Boulevard near Penguin Avenue in Fountain Valley the night of October 30, 2010. Police say that Henningsgaard may have stepped into traffic on Harbor Boulevard before being hit by the two vehicles. He was pronounced dead at the scene. Police are investigating the crash and they are searching for more information.

My heartfelt condolences go out to the family and friends of Kelly Jay Henningsgaard. My thoughts and prayers are with them during this difficult time.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 10 people were injured in Fountain Valley pedestrian accidents. In Orange County as a whole, there were 31 fatalities and 785 injuries as a result of pedestrian accidents during the same year.

What Caused This Fatal Pedestrian Accident?

The news account does not provide much detail about what exactly led to this fatal injury accident. Motorists in California are required to yield right-of-way to pedestrians in crosswalks, under California Vehicle Code Section 21950. However, that does not relieve pedestrians from the duty of exercising caution and due care as they walk on the road.

The same section also states pedestrians should not dart across traffic lanes or suddenly enter a roadway. Pedestrians must walk only in areas that are designated for pedestrians such as crosswalks, sidewalks and so on. In this particular case, it is not clear where the pedestrian was walking. Police must interview more witnesses and conduct a thorough investigation in order to determine precisely what occurred.

Liability Issues

The family of a victim killed in a pedestrian accident would be well advised to contact a skilled Orange County personal injury lawyer, who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected. If the driver in this case is determined to have been at fault, he or she could be held financially responsible for Henningsgaard’s wrongful death. In such cases, the family of a deceased victim can seek compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages.
