San Diego Car Accident Injures Pedestrian

A man was seriously injured in a San Diego car accident after a car struck him the morning of January 20, 2010. According to a news report in The San Diego Union-Tribune, the accident occurred on El Cajon Boulevard near 50th Street in the City Heights area when the man was struck by a 1992 Chrysler. The driver remained at the scene and has apparently not been cited or arrested pending an official investigation.

San Diego Pedestrian Accidents

There were 25 fatalities and 575 injuries involving pedestrian accidents in San Diego, according to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS). Countywide, 51 deaths and 1,068 injuries were reported as a result of pedestrian accidents in 2007. Also, in San Diego County, car accidents claimed 268 lives and injured 14,641 people during the same year.

What Caused this Injury Collision?

Based on this news report, it is not exactly clear where this pedestrian was walking, why he was struck and how he was injured. Was the pedestrian in a crosswalk or at an intersection? California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
