Accident Statistics

There were 35 fatalities and 3,577 injuries involving car accidents in San Francisco in 2008, according to California Highway Patrol’s traffic accident statistics. Also, during the same year, three people died and 471 were injured as a result of bicycle accidents in San Francisco.

Causes and Liability Issues

This news article does not clearly state how or why this accident occurred. We do not know where the bicyclist was riding at the time. Was he in a crosswalk or riding along the side of the road? Was he riding the bike or walking his bike? Did one of the parties involved fail to yield right-of-way? Was the driver of the streetcar under the influence or distracted at the time of the accident? I trust the results of this investigation will shed more light on what occurred here.

If the driver of the streetcar is determined to have been at fault, he as well as the Muni could be held liable for the resulting accident and injuries. Under California Government Code section 911.2, any personal injury claim against a public entity must be filed within six months of the accident or injury. An experienced San Francisco personal injury lawyer will be able to advise victims in such cases about their legal rights and options. Victims could seek compensation to cover medical expenses, loss of wages, hospitalization, surgery, pain and suffering and other related damages.
