U.S. Marine Killed in San Diego Motorcycle Accident

A 21-year-old U.S. Marine was fatally injured in a motorcycle accident in Escondido after he lost control of his cycle and crashed. According to a news report in the North County Times, the fatal motorcycle accident occurred the afternoon of April 16, 2011 on Highway 78 just west of Interstate 15. The Marine failed to negotiate a curve on the highway and was thrown from his motorcycle, according to a medical examiner’s report. He was transported by ambulance to a local hospital where he died shortly afterward. An investigation is ongoing.

I offer my deepest condolences to the family and friends of this deceased victim. My heart also goes out to his fellow Marines. They will be in my thoughts and prayers.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one person died and 44 were injured as a result of motorcycle accidents in Escondido. In San Diego County as a whole, 51 fatalities and 1,081 injuries were reported as a result of motorcycle accidents during the same year.

What Caused This Fatal Motorcycle Accident?

Based on this news report, it is not quite clear what caused this Marine to lose control of the motorcycle. Was there an auto defect, which may have caused the motorcycle to go out of control? Was the Marine an experienced rider? Was there a dangerous condition on the roadway, which may have caused or contributed to this incident? Were there any other vehicles involved? I trust officials are looking into these and other factors in order to determine what occurred here and why.

Fault and Liability

If a vehicle defect caused this accident, then, the maker of the motorcycle or the manufacturer of the defective product can be held liable. If the accident was caused by a dangerous roadway, then, the governmental agency responsible for maintaining the roadway can also be held liable. Families of deceased victims would be well-advised to contact an experienced San Diego personal injury lawyer, who will stay abreast of the official investigation and make sure that all the negligent parties are held liable.

It would also be a good idea for the family to preserve the motorcycle so an expert can closely analyze it for any evidence of product defects or malfunctions. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to car accident victims and their families.
