Five people were injured, one critically, in a San Francisco car accident after a pickup truck and SUV crashed at the intersection of Polk and Hayes streets. According to a CBS news report, the injury collision occurred near the San Francisco City Hall the morning of September 13, 2010. Officials say a southbound pickup truck crashed into the right side of a westbound black SUV as both cars entered the intersection, which is controlled by a stop light. Police are looking into who was at fault and who had right-of-way at the intersection. An elderly woman and a young girl were among the injured.

San Francisco Car Accident Statistics

According to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS), 35 people were killed and 3,577 people were injured in 2008 San Francisco car accidents.

Stop Light Laws

This car crash took place at an intersection that has traffic lights. Based on this news report, it is not yet clear whether this accident occurred as a result of one of the drivers running a red light or failing to yield right-of-way. California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”

Liability Issues

The driver who is determined to have been at fault in such cases could be held liable for the accident and injuries caused. Injured victims could seek compensation to cover medical expenses, loss of earnings, cost of hospitalization, rehabilitation and other related damages. Victims and their families would also be well-advised to contact an experienced San Francisco personal injury lawyer, who will analyze all facets of the incident and ensure that the negligent parties are held liable for their actions. A knowledgeable car accident lawyer should also advise victims and their families about how their car insurance policy applies to an incident where the at-fault motorist is uninsured or underinsured.
