Police Looking for Driver

Police said the pedestrian was walking across the intersection in a marked crosswalk when they were hit by the red or maroon vehicle traveling north on Superior. The victim suffered major injuries. Our thoughts and prayers are with the injured victim of this hit-and-run accident. We wish this victim the very best for a speedy and complete recovery.

Leaving the Scene of a Crash

Based on this news report, it appears that the driver of the SUV struck the pedestrian who was walking in a marked crosswalk and then left the scene of a major injury crash. California Vehicle Code section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”

In addition, California Vehicle Code Section 20001 (a) prohibits motorists from leaving the scene of an injury or fatal crash. Drivers are required to stop right away, remain at the scene and obtain help for the injured victims. The law states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”

Hit-and-run victims not only face physical trauma and emotional distress, but also significant financial burdens in terms of medical expenses, lost wages and other costs that come from being injured and unable to work. Injured victims in such cases would be well advised to contact an experienced Newport Beach car accident lawyer who represents hit and run victims, who will remain on their side, fight for their rights and help them secure the compensation they need and rightfully deserve.

A knowledgeable lawyer will also be able to help victims understand how their own auto insurance policy might apply in a case where the hit-and-run driver has not been identified or when the at-fault driver is uninsured or underinsured.
