Two Injured in Orange County Accident

A police officer and a driver were injured in a Huntington Beach car accident when the officer’s motorcycle and a car collided at a street intersection. According to a news report in The Orange County Register, the injury motorcycle accident occurred at the intersection of Brookhurst Street and Adams Avenue the night of January 1, 2011. The Irvine police officer and the driver of a 2005 Mercedes sustained moderate injuries when their vehicles collided. An investigation is ongoing.

My thoughts and prayers are with both men injured in this Orange County auto accident. I wish them both a speedy and complete recovery from their injuries.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 49 people were injured in Huntington Beach motorcycle accidents. During that same year, there were 35 fatalities and 801 injuries reported as a result of motorcycle accidents in Orange County, California.

What Caused This Injury Car Accident?

Based on this news report, it is not clear who was at fault for this injury car accident. The intersection where this accident took place is monitored by traffic signals. I trust investigators are looking into whether one of the drivers failed to properly yield right-of-way at the intersection or failed to obey the traffic light. According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” It is also against California Vehicle Code Section 21453 (a) to run a red light at a street intersection.

Fault and Liability

Victims of negligent drivers may pursue financial compensation for their injuries by filing a personal injury claim. Compensation may be available for medical bills, lost wages, hospitalization, rehabilitation and other related damages. Car accident victims would also be well-advised to contact an experienced Orange County personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable. A knowledgeable car accident lawyer will also be able to determine if a dangerous intersection or roadway condition may have caused the accident. If that was the case, the city or public entity responsible for maintaining that roadway could also be held liable. Under California Government Code Section 911.2, any personal injury claim against a governmental agency must be filed within 180 days of the accident or injury.
