San Diego Car Accident Injures Pedestrian

A pedestrian was injured in a San Diego car accident, which police say, occurred after a driver made an illegal U-turn. According to a news report in The San Diego Union-Tribune, the injury car accident happened at the intersection of Rosecrans and Kurtz Streets the night of November 20, 2010 in the Midway District of San Diego. The pedestrian, described only as a man in his 40s, was crossing Rosecrans when the driver of a Ford Ranger made an illegal U-turn and struck him. The man sustained a broken femur and was transported to an area hospital. It is unclear from the report if the truck driver was cited for the accident. An investigation into the incident is pending.

My thoughts and prayers are with the injured victim of this San Diego pedestrian accident. I wish him a complete and speedy recovery from his injuries.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 23 people were killed and 533 were injured in San Diego pedestrian accidents. During that same year, there were 63 fatalities and 998 injuries as a result of pedestrian accidents in San Diego County.

The Law Relating to U-turns

Under California law, motorists are required to use due care and caution while making a U-turn. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Liability Issues

If the driver is determined to have been at fault here, then he or she could be held liable for the pedestrian’s injuries. Injured car accident victims could seek compensation to cover medical expenses, loss of earnings, cost of hospitalization, rehabilitation and other related damages. Victims in such cases would also be well-advised to seek the counsel of an experienced San Diego personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable for their actions.
