Motorcyclist Injured in Santa Ana Car Accident

By

A man was injured in a Santa Ana car accident involving a collision between a Harley-Davidson and a white Honda Accord, the morning of August 30, 2011. According to a news report in The Orange County Register, the motorcycle accident occurred on North Bristol Street, near Memory Lane, in Santa Ana. The motorcyclist was northbound on Bristol Street when a Honda exiting an apartment complex struck the Harley. The rider was injured and transported to a local hospital. The Honda’s driver was not injured in the crash. An investigation is ongoing.

My thoughts and prayers are with the motorcyclist injured in this Orange County car accident. I wish him the very best for a complete and speedy recovery.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), 46 people were injured in Santa Ana motorcycle accidents. During that same year, there were 17 fatalities and 735 injuries reported due to Orange County motorcycle crashes.

What Caused This Injury Accident?

Based on this news report, it appears that the car’s driver pulled out of a private driveway and struck the motorcyclist. It is unclear as to why the driver of the Honda failed to see and yield right-of-way to the oncoming motorcycle. According to California Vehicle Code Section 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”

Liability Issues

If it is determined that the driver of the Honda caused this crash, then, he or she can be held financially responsible for the motorcyclist’s injuries. Car accident victims can seek compensation for damages including, but not limited to medical expenses, lost wages, cost of hospitalization, and rehabilitation. Victims in such cases would be well-advised to contact an experienced Santa Ana personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.

Many drivers feel that motorycylists are much more difficult to see. Do you think the automobile drivers are 100% at fault or that motorcylists should have to wear more visible clothing?
