Motorcyclist Killed in Los Angeles Car Accident

By

Michael Roberts, 30, was killed in a Los Angeles car accident when his motorcycle was hit by a vehicle that was exiting a private driveway. According to a report in the Los Angeles Daily News, the fatal motorcycle accident occurred on Chatsworth Street, near Zelzah Avenue, in Chatsworth, the morning of July 2, 2011.

Roberts was riding his 2000 Ducati motorcycle east on Chatsworth Street, when a Toyota, driven by Helen Heanue, 80, crossed the street from one private drive toward another and struck the motorcycle. Roberts was ejected from his motorcycle. He was transported to a local hospital where he died from his injuries. Heanue was injured in the crash as well and has been listed in fair condition.

My heartfelt condolences go out to the family and friends of Michael Roberts following this tragic motorcycle accident. My thoughts and prayers are with his family during this difficult time.

Los Angeles Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 42 people were killed and 1,289 were injured in Los Angeles motorcycle accidents. During that same year, there were 114 fatalities and 2,934 injuries reported involving Los Angeles County motorcycle accidents.

Yielding Right-of-Way

It appears from the report that the elderly driver of the Toyota failed to yield right-of-way to the motorcycle rider who was on the roadway. According to California Vehicle Code Section 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”

Fault and Liability

The family of a victim killed in a Los Angeles car accident may seek financial compensation for their losses by filing a wrongful death claim in cases where negligence or wrongdoing is involved. Such claims usually seek compensation for medical and funeral costs, lost future income and benefits such as pension and insurance, loss of companionship, and other related damages. An experienced Los Angeles personal injury lawyer will be able to better advise victims’ families in such cases about their legal rights and options.
