Infant Critically Injured in Los Angeles Car Accident

By

A 2-month old boy suffered life-threatening injuries in a Los Angeles car accident after he was struck by a vehicle on July 14, 2011. According to a news report in the Los Angeles Times, the major injury collision occurred on Spring Street in downtown Los Angeles, when the driver of a Cadillac DeVille was attempting to park near 4th and Spring streets. Officials say the driver hit the gas pedal instead of the brake. The car jumped the curb and struck a stroller with the infant inside. The baby was transported to an area hospital. The child’s mother was not injured. An investigation is ongoing.

My heart goes out to the parents of this child and their family members for what they are going through at this time. The baby is apparently on life support at this time. I truly hope this child makes it through these injuries and goes on to make a complete recovery. Please keep this child and his family in your thoughts and prayers.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 104 fatalities and 2,716 injuries involving pedestrian accidents in the city of Los Angeles. In Los Angeles County as a whole, 214 people died and 4,985 were injured due to pedestrian accidents during the same year.

What Caused This Tragic Crash?

Based on this news report, it appears that the driver hit the gas pedal instead of the brake. However, it is not clear what caused the driver to do so. Some news reports say that the driver was bare-footed at the time. It is not clear if his foot slipped. I trust officials are also looking into whether the man was intoxicated, inattentive, distracted or otherwise negligent at the time.

Fault and Liability

Officials say the man is not likely to be arrested at this time. Even if he is not charged of a crime or arrested, at-fault parties in such cases can be held civilly liable for the injuries and damages they have caused. Injured victims can seek compensation for all medical expenses, hospitalization and rehabilitation costs.
