Pedestrian Injured in Orange County Car Accident

By

A pedestrian was injured in an Orange County car accident after a female driver accidentally hit the accelerator instead of the brake and drove through a store window. According to a news report in The Orange County Register, the injury pedestrian accident occurred the evening of March 29, 2011 at a 7-Eleven store at the corner of Main Street and Palmyra Avenue in Orange. The GMC Sierra pickup truck struck a guard rail and plowed into the entrance of the convenience store. The rail hit a female pedestrian. Officials say she sustained injuries which are not life-threatening. No one else was injured.

My heart goes out to the injured pedestrian. I’m relieved to note that she did not sustain major injuries in this car accident. I wish her the very best for a speedy and complete recovery. She will be in my thoughts and prayers.

Pedestrian Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one person died and 49 were injured in pedestrian accidents in Orange. In Orange County as a whole, 31 fatalities and 785 injuries occurred due to pedestrian accidents during the same year.

What Caused This Car Accident

Based on this news report, it is not clear why the woman mistook the accelerator for the brake. There are several questions here. Was the woman intoxicated at the time? Was she distracted or inattentive? Was the woman disoriented or did she have some medical condition, which caused her to become disoriented? I trust authorities are looking into these and other factors in order to determine why this incident occurred.

Fault and Liability

If the driver of the pickup truck is determined to have been at fault, then, she could be held liable for the pedestrian’s injuries. Injured victims in such cases could seek compensation for medical expenses, loss of wages, cost of hospitalization, physical therapy and other related damages.

Nice to hear that the victim did not sustain serious injuries. However, she should not have experienced this life-threatening accident only if the driver has become more careful and prudent enough. Yes, the authorities should conduct further investigations to make sure that the driver will be held liable for all the damages.
