Police Officer Injured in Motorcycle Accident

A police officer was injured in a San Francisco area car accident after his motorcycle was rear-ended by another vehicle the evening of February 1, 2011. According to a report in the San Jose Mercury News, the motorcycle accident occurred at the intersection of San Pablo Avenue and 43rd Street in Emeryville. The officer was stopped at the intersection while pedestrians crossed the street. At that moment a northbound vehicle failed to stop and struck him from behind. The officer was transported to an area hospital, but his injuries are not considered to be life threatening. Police say the motorist failed to even slow down while approaching the intersection. An investigation is ongoing.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
