Los Angeles Car Accident Injures Baby in Stroller

By

A baby in a stroller sustained injuries in a Los Angeles car accident after the stroller was struck by a vehicle at a street intersection. According to a news report in the Glendale News-Press, the injury pedestrian accident occurred at the intersection of East Jackson and Harvard streets in Glendale the morning of December 7, 2010, when a driver heading south on Jackson made a left on Harvard and hit the stroller that was being pushed by the mother . The stroller tipped over with the baby still inside, but thankfully, the child did not appear to have suffered any major injuries. The baby was transported to a local hospital as a precaution. An investigation is ongoing.

My heart goes out to this mother and child for their traumatic experience. It is extremely fortunate that the baby was not seriously injured. Please keep this family in your thoughts and prayers.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 91 injuries involving pedestrian accidents in Glendale. In Los Angeles County as a whole, 214 people died and 4,985 were injured due to pedestrian accidents in 2008.

Pedestrians’ Right-of-Way

Based on this news report, it appears that the woman and the child were in a crosswalk at this intersection when the baby was struck. Motorists are required under California law to yield right-of-way to pedestrians walking in marked or unmarked crosswalks.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Protecting Victims’ Rights

A car accident victim can seek compensation from the at-fault driver for all injuries, damages and losses sustained. In such cases, victims or their families would also be well-advised to contact an experienced Los Angeles personal injury lawyer, who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected.
