Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one person was killed and 49 were injured in Orange pedestrian accidents. During that same year, there were 31 fatalities and 785 injuries reported as a result of pedestrian accidents in Orange County.

Possible Car Accident Causes

Under California law, skateboarders must adhere to pedestrian laws and exercise due caution while crossing the street. Also, drivers must yield the right-of-way to pedestrians who are walking in marked or unmarked crosswalks. There are several questions here. Was the driver distracted or inattentive? Did low visibility or a lack of street lighting contribute to this car accident? Did the skateboarder run into traffic lanes?

Liability Issues

If officials determine that the driver was at fault for the accident, then he or she could be held liable for the victim’s injuries. An experienced Orange County personal injury lawyer should also determine whether a dangerous roadway condition caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining the roadway could also be held liable. Please remember that any personal injury claim against a public entity must be properly filed within 180 days of the incident under California Government Code Section 911.2.
