Fresno Area Car Accident Proves Fatal

Joshue Domingcil, 62, was killed in a fatal car accident, which police believe, may have involved drunken driving. According to a news report in the Visalia Times-Delta, the fatal car accident occurred on Highway 63 near Avenue 328 the night of October 12, 2010. Domingcil was traveling north on the highway in his gray Mitsubishi Mirage when he veered into the southbound lanes and collided head-on with a Dodge Caravan. Domingcil was fatally injured in the car accident and two occupants of the Caravan, Ricky Edward Duran, 55, and Michael Mitchum, 53, were hospitalized with major injuries. Duran was later arrested on suspicion of driving under the influence.

Police believe that the fatally injured driver of the Mitsubishi may have caused this car accident by entering into oncoming traffic lanes. According to California Vehicle Code Section 21651 (a): “Whenever a highway has been divided into two or more roadways by means of intermittent barriers or by means of a dividing section of not less than two feet in width, either unpaved or delineated by curbs, double-parallel lines, or other markings on the roadway, it is unlawful…to drive any vehicle over, upon, or across the dividing section.”

Also, the injured victim of this car accident, Duran, was later arrested on suspicion of driving under the influence. Driving under the influence of alcohol or drugs is a serious crime under California law. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”
