Pedestrian Accidents
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 13 deaths and 80 injuries involving pedestrian accidents in the unincorporated areas of San Diego County. Also, countywide, 63 fatalities and 998 injuries were reported as a result of pedestrian accidents in 2008. In San Diego County as a whole, 246 deaths and 13,527 injuries were reported as a result of traffic accidents during the same year.
What Caused this Accident?
This news report leaves a number of questions unanswered. It is not quite clear who was at fault here. Where exactly was the woman walking at the time of the accident? Was she in a crosswalk at the time? Was she walking along the side or shoulder of the road? Was she walking across traffic lanes? Did the driver of the car fail to yield right-of-way to the woman?

California law requires motorists to yield right-of-way to pedestrians who are crossing the street or walking on the street legally. However, just as the motorist has a responsibility, pedestrians are also required to yield right-of-way to oncoming vehicles.
