San Diego Car Accident Kills Man Eating Breakfast

By

A 65-year-old man was killed in a San Diego car accident the morning of January 3, 2010, after an SUV plowed into the restaurant where he was eating breakfast and struck him. According to a news report in the San Diego Union-Tribune, the silver Honda CRV, driven by a 74-year-old man, slammed into a Carl’s Jr. restaurant in El Cajon and sent the man hurtling from the front booth where he was eating, to the other side of the building. The driver, who has not been identified, sustained moderate injuries. No one else was injured in the crash.

My heart goes out to the family and friends of this victim for their heartbreaking loss. Employees at the Carl’s Jr. said the man was a regular for breakfast at their restaurant. Tragic! This grieving family will certainly be in my prayers.

How and Why did this Accident Occur?

This news report offers quite a bit of information about the circumstances of this tragic pedestrian accident. Several eyewitnesses at the shopping center say they saw the man’s SUV zoom past them at a high rate of speed. Police say the man had just tried to use an ATM machine near the Carl’s Jr. before backing up and driving about 150 yards across the parking lot and slamming into the restaurant.

A witness said he did not see the driver attempting to brake or swerve. Another witness said he ran to help the driver immediately after the accident and saw the man lying across the passenger seat, unconscious and bleeding. But the driver then opened his eyes and said he did not need an ambulance. Yet another witness said the man left the ATM frustrated and left the bank card in the slot.

Claim for Compensation

There are still many questions here. Did the driver deliberately crash his vehicle? Did he suffer a medical condition? Was he driving recklessly? The victim’s family members certainly deserve to know the answers. If negligence or wrongdoing was involved here, the victim’s family will be able to file a wrongful death claim against the driver seeking compensation for funeral expenses, loss of earnings (if applicable), loss of love and companionship and other damages. An experienced San Diego personal injury attorney will stay on top of this investigation and make sure that the victim’s family receives the justice and compensation they rightfully deserve.

Wow, this is sad. One man’s reckless rage kills another who is just eating breakfast. Makes me think how unpredictable life can be. You’ll never know when it is your time. Eating breakfast at a Carl’s Jr seems very peaceful yet somebody died.
