By

Rafael Vega, 47, Fernando Paz, 29, and four others were injured in a Ventura car accident the afternoon of August 30, 2009 involving a suspected drunk driver. According to a news report in the Ventura County Star, 64-year-old Abel Flores Torres was driving north on Piru Canyon Road in Fillmore when his vehicle drifted to the southbound lame. California Highway Patrol officials say Vega was driving south and attempted to avoid Torres’ vehicle by swerving right. But Torres’ car still struck Vega’s vehicle. Torres then crashed into a third vehicle driven by Paz. All three drivers and three passengers were taken to a local hospital for treatment of various injuries. Torres was arrested on suspicion of drunk driving.

I’m relieved that no one was severely injured in this DUI car accident. I wish the injured victims the very best for a quick and complete recovery. Please keep them in your prayers.

Ventura Car Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but three injuries reported in Fillmore as a result of alcohol-related car accidents In Ventura County as a whole, there were 28 deaths and 481 injuries in 2007, involving alcohol-related car accidents.

If Torres is found guilty of DUI in this California car accident, he should be held criminally and civilly responsible for this accident and the resulting injuries. Victims in such cases may be eligible to seek compensation to cover medical expenses, loss of wages and other related damages.

California Car Accident Law

Driving under the influence of alcohol and/or drugs is not only unethical and irresponsible, but it is also a serious offense. California Vehicle Code Section 23152 (a) states: “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” The same code section also states that it is illegal for any person with a blood alcohol content of 0.08 percent or more to drive a vehicle.

Victims who are injured by drunk or negligent drivers would be well-advised to retain the services of an experienced California personal injury lawyer who has a successful track record of financially pursuing DUI drivers and holding them accountable. In cases where a car accident results in death, families of deceased victims may be able to file a wrongful death claim to seek compensation for funeral expenses, loss of earnings and other related damages.
