A recent article in U.S. News talks about those nursing homes that are rated as "Special Focus Facility." The truth is there is nothing good or positive about the word "special" here. A Special Focus Facility is basically a nursing home with a history of negligence or consistently substandard results in health inspections - one that has been tagged for extra monitoring and inspections by the federal Centers for Medicare and Medicaid Services as well as the state where it operates. In other words, you want to stay away from these "special" nursing homes.</p>

<p>How does a nursing home gain this dubious status? It doesn't happen with a single health deficiency. For a nursing home to be tagged it would have to have three serious problems at three consecutive inspections. If repeat inspections were necessary because the nursing home did not rectify the problem, that becomes a serious issue as well. According to the Centers for Medicare and Medicaid Services there are about 135 nursing homes on this list. California has six of these homes. Officials say many more nursing homes should be on this list, but aren't because the federal agency simply does not have the resources or the manpower to go after these homes and conduct these inspections.</p>]]>
        <![CDATA[<p>The lack of resources at the federal level and state level here in California has been a huge problem. We've reported earlier that Gov. Arnold Schwarzenegger took the axe to the state's nursing home ombudsman program where volunteers go into these facilities and conduct random inspections; something the state health department does not have the resources to do anymore. But now, with this volunteer program also drastically cut, nursing homes are free to carry on business as usual. If they neglect their residents, understaff their facilities or do not maintain proper safety procedures, there are not many people watching them. A number of unsuspecting, vulnerable people suffer serious <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injury</a> or even death as a result of such negligence. Of course, this is a frightening situation to be in, but we're in it right now.</p>

<p>The best solution for consumers is to really do their research before entrusting their loved one to a nursing home. The car crash occurred on the eastbound lanes near Paramount Boulevard and involved five cars, one of which caught on fire just after its driver managed to escape from the wreckage. Six suffered injuries -- one critical and one moderate. Four others sustained minor injuries. Four out of the six injured victims were taken to area hospitals. The critically injured driver was expected to survive, Long Beach fire officials said. One motorist had to be extricated from the vehicle. Long Beach traffic investigators are still not sure what caused the car accident or who was at fault.</p>

At least one person was taken to the hospital after the car collision. The pickup being driven by the suspected drunk driver was apparently carrying a load of nails. As the truck rolled over, the nails spilled all over the freeway, California Highway Patrol officials said. No other car accidents were caused by the spilled debris.</p>

<p>The driver of the pickup truck in this case should be held criminally and civilly responsible for the injuries caused to the victims. If he was on-the-job at the time of the car crash, his employer could also be held liable for the accident and resulting injuries. It is fortunate that no other accidents were caused as a result of the debris (nails) that were spilled onto the roadway. If that had occurred, the pickup driver (and possibly his employer) could have been held liable for those injuries as well.         <![CDATA[<p>Rodrigo "Rod" Armas, 45, died in a <a href="http://www.bestattorney.com/bicycle-accident.html" target=_blank">Los Angeles County bicycle accident</a> after both he and his son were struck by a truck while cycling east along Pacific Coast Highway, the Ventura County Star reports. The hit-and-run bicycle-car crash occurred early morning on June 28, 2009 near the 34000 block of Pacific Coast Highway in Malibu. Armas and his 14-year-old son were hit by a suspected drunk driver while riding on the shoulder of the highway. Armas died at the scene while his teenage son was taken to the hospital with several broken bones. </p>

<p>The truck driver, 30-year-old Robert Sam Sanchez, fled the scene, but was arrested a short distance away from the accident scene. He was still displaying signs of alcohol intoxication, officials said. Sanchez apparently works for the city of Malibu and lives in Oxnard. It is not clear whether he was on the job or returning from a city event at the time of the fatal <a href="http://www.bestattorney.com/los-angeles-car-accidents.html" target=_blank">Los Angeles car accident</a>. Armas and his son were on their way back to Malibu during the annual 200-mile Los Angeles Wheelmen "Grand Tour" event.</p>

<p>It's hard to understand how a driver can strike a man and a young boy and leave them to die on the street. Obviously in this case, Sanchez took off because he knew he was intoxicated and would get in trouble if apprehended. Well, he is in serious trouble now. He is certain to face felony driving under the influence and vehicular manslaughter charges in connection with this fatal bicycle accident – as he should. Leaving the scene of an accident is a serious violation of California law. </p>

<p><em>California Vehicle Code section 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."</em></p>

According to an article in The Orange County Register, Montgomery was riding the motorcycle west on Garfield Avenue near Edwards Street. A gold, four-door sedan was traveling east on Garfield. The sedan then turned north onto Edwards ahead of Montgomery, who crashed into the car, Huntington Beach police said. At the very least, it seems that the driver of the sedan should have been able to avoid hitting Montgomery.</p>

The Silverado apparently sideswiped a Ford pickup and then hit the Civic. A Daewoo sedan was also caught up in the fatal car crash.</p>]]>

Shinder Randhawa, 51, the driver of the Ford and his passenger, Gagandip Randhawa, 25, and the driver of the Daewoo, Maria Tostado, 26, suffered minor injuries. The suspected drunk driver, Willie Rivera, survived the <a href="http://www.california-lawyer-attorney.com" target="_blank">car accident</a> and was arrested on suspicion of driving under the influence and vehicular manslaughter.</p>

<p>My heart goes out to the family and friends of the three victims who were killed in this fatal DUI car crash. I offer my deepest condolences to them. <p>According to a news article on Consumer Reports, this new report released by Safety Research and Strategies (http://www.safetyresearch.net/chrysler-gm-bankruptcy) looks into the implications of a provision in the GM and Chrysler bankruptcies that allows the automakers to avoid liability for the vehicles made before the bankruptcy. The report projects that based on information provided by both GM and Chrysler and the National Highway Traffic Safety Administration (NHTSA), more than 3,400 Americans will be injured or killed by a defective Chrysler of GM vehicle during the first year after the bankruptcy.</p>]]>
        <![CDATA[<p>Both GM and Chrysler sought protection in their bankruptcy proceedings from pending and future liability claims against their auto products manufactured before their Chapter 11 bankruptcy filings. Because of the fact that the NHTSA uses death and injury data to look for auto product defect trends, the absence of such claims might very well decrease or have a curbing effect on the number of product recalls conducted by automakers during the post-bankruptcy era. </p>

<p>I absolutely agree with Sean Kane, the president of Safety Research and Strategies. If these product liability claims are not filed we do lose an important "defect surveillance tool." That means we give these auto makers a "get out free" card where they don't have to be held accountable or bear liability for deaths and serious <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> caused by their product defects. Basically, there is no incentive for GM or Chrysler to recall their defective vehicles. </p>

<p><em> A close look at the statistics of death and injury claims fielded by these two large U.S. automakers reveals some shocking details. Between the third quarter of 2003 and the fourth quarter of 2008, Chrysler was looking at 3,497 death and injury claims. GM fielded a whopping 15,284 death and injury claims during that same period. These claims collectively represent an annual average of 636 and 2,779 casualties respectively! GM and Chrysler account for more than 40 million fleet vehicles in the United States and the two companies also accounted for nearly half of all claims filed against auto manufacturers during the above-mentioned time period. </em></p>

<p>Despite these staggering numbers, GM and Chrysler represent only 38 percent of the market share. Between 2004 and 2008, Chrysler issued 109 product recalls affecting 11.4 million vehicles while GM issued 129 recalls that affected 19 million vehicles. Texas, California, Florida, Ohio and New York lead the nation in a state-by-state breakdown of Chrysler and GM death and injury claims.</p>

<p>There is no question that public safety is at jeopardy here. Based on Chrysler and GM's history of death and injury data and claims, there is no reason to believe that the vehicles they have produced will be defect free. Deaths and injuries as a result of malfunctioning autos made by these two companies will still continue. What protections and safeguards are in place for consumers? So far, not much and that to me is deeply disturbing.<br />

These citations carry fines of $25,000 to $100,000. </p>

<p>My heart goes out to the family of the deceased victim, who apparently died because this Los Angeles nursing home neglected to properly care for him after he fell. Why did he fall in the first place? Why was a wheelchair-bound man trying to get up and walk on his own? Did he call for help before he ventured to get off his bed? How long did he wait for staff to arrive before he decided to get up on his own? What type of safety supports were or weren't present in his room? How has the nursing home changed its procedures after this incident? All these questions must be answered to really understand the seriousness of the problem here.</p>

<p>Nursing home negligence and abuse has been on the rise for the last several years and these tragic incidents of neglect and abuse only seem to be increasing. The trailing train is said to be one of the oldest in the Metro fleet. The National Transportation Safety Board (NTSB) is investigating the incident.</p>]]>

<p>For us here in Southern California, memories of the Chatsworth Metrolink train accident  in September 2008 are still fresh. In that train accident 25 people were killed and more than 125 were injured. The operator of that train, who also died, was said to have been texting train enthusiasts seconds before he bypassed a red light and crashed into a freight train. Last month, 50 people were injured in Boston when one trolley rear-ended another. The conductor admitted to have been texting when the crash occurred.</p>

<p>At this time, it's not clear exactly why this Washington D.C. train crash occurred. Was the driver distracted? Was she texting or talking on a cell phone? Was fatigue a factor? How many hours had she been working on that shift? Was there a mechanical malfunction with that train, which is one of the oldest on Metro's fleet? I trust we will start finding out more details as NTSB's investigation progresses.</p>

Still, the company did not remove Zicam products from the market pending additional study. They didn't even warn consumers despite getting a flood of complaints from consumers who had used the product and had lost their ability to smell.</p>

<p>It is disgusting that Zicam acted with such callous disregard toward consumers. Despite knowing that their products were injuring consumers or had the potential to injure consumers, they not only continued to market them as effective cold remedies, but also did not make any effort to warn users about possible adverse drug effects. They simply didn't care that these defective products could destroy someone's quality of life or put them in a dangerous situation. There is no question in my mind that the manufacturer of these defective Zicam products should be held liable for the grief and damages they have caused hundreds of consumers nationwide over the last several years.</p>

Six passengers on the bus suffered personal injuries and all 23 were pulled through the windows after the bus crashed into the wall, San Bernardino County Fire Department officials said. The Los Angeles-bound charter bus had just picked up the passengers from the casino. Police are apparently still investigating what caused the bus-car accident, but based on the preliminary investigation, they are placing the blame on the driver of the pickup truck. Police say they believe alcohol or drugs may have played a part in this bus collision.</p>
