Two people, one of them identified as 25-year-old Sean Hendrick, were injured in a pedestrian accident in Ojai the evening of September 2, 2010. The Ventura County Star reports that the crash happened near the intersection of El Paseo Road and Canada Street when Hendrick and a 17-year-old girl were crossing the street. Hendrick suffered head injuries and the girl was also injured, but neither sustained life-threatening injuries, officials said. Lavonne Vail, the driver of the vehicle that hit the pedestrians told police that she was not able to see them because of the sun’s glare.

I’m relieved to hear that neither one of the victims suffered critical or catastrophic injuries. I pray that they recover fully and quickly from their injuries.

According to a news report in the Modesto Bee, the fatal crash occurred at the intersection of Third Avenue and Highway 165 in Stevinson on September 6, 2010. An arbitrator has ruled that a former Toyota Motor Corp. attorney can use internal company documents to support his claim that the Japanese auto maker deliberately hid evidence in their auto products liability lawsuits. According to a news report in the Los Angeles Times, the former attorney, Dimitrios Biller, alleges that Toyota officials hired him to plan and carry out discovery fraud on behalf of the company.

Internal Documents to Tell the Story

The arbitrator’s ruling clears the way for internal memos, e-mails, test reports and other documents to be used as evidence in this case. It is no doubt a major legal setback for Toyota and a victory of plaintiffs attorneys in numerous pending auto products liability cases against the auto maker – most of them related to faulty gas pedals and defective floor mats that resulted in unintended acceleration. Now these auto product liability lawyers can subpoena the documents as evidence to help bolster their cases.

Sgt. Dave Welch of the Rohnert Park Police Department was injured in a car accident the morning of September 5, 2010, which officials say, was caused by a suspected drunk driver. According to a Bay City News report, the injury crash occurred when 27-year-old Joshua Hicks, who was traveling at a high rate of speed, lost control of his vehicle and crashed head-on into a police SUV. Hicks attempted to leave the scene of the crash, but Sgt. Welch used the SUV to push Hicks’ vehicle against the curb. Hicks was arrested on suspicion of DUI. Initial tests showed that he had a blood alcohol level of 0.16 percent — which is over twice the legal limit. Sgt. Welch suffered injuries to his arm, back and shoulder.

My heart goes out to this police officer. I hope his injuries are not severe and pray for his speedy and complete recovery. I’m glad that he was able to stop the driver, who was apparently intoxicated and uncooperative to officials, from getting back on the road and possibly injuring others.

Julie Farris suffered severe brain injury after being struck by a trolley on the Azusa Pacific University Campus in the City of Azusa, California. At the time of the accident, Julie was riding her bicycle on the 800 Block of East Foothill Boulevard, the main roadway that links the East and West campuses.

The 800 Block was, and had been for some time, in dangerous condition. Many students struggled to travel this road numerous times a day, and were forced to weave around parked cars and congested traffic within the small usable space of the roadway. At the time of the accident, Julie had to ride her bike on the opposite side of the road, against traffic, because of the complete disorganization and lack of space on the side that went with the flow of traffic. It was at this point that she was struck by the trolley.
