California Wage & Hour Violations

There are several ways in which California workers can have their rights violated by employers in terms of work hours and pay. Each of these types of wage and hour violations involves a different type of legal remedy, so it is important, if you have been denied fair payment for your work, that you talk to a good personal injury lawyer who understands the laws regarding payments to employees.

One way your rights can be violated in terms of payment for work is if you are simply denied compensation altogether. An employer might ask you to work “off the clock,” and imply that if you do not you could lose your job. An example of this is when employers tell employees that they did not finish their work in a “timely manner” and must finish “on their own time.” However, it is against California employment law for any employer to require employees to work without compensation.

Another way your rights can be violated is by denying overtime compensation to you based on some classification the employer says you fall under. For example, a salaried employee might be denied overtime pay because she is not an "hourly" employee. However, a salary does not mean that an employer can legally require you to work longer hours for the same pay.

Bard Avaulta Recall Overview

For many years, women suffering from pelvic organ prolapse, or POP, could do little to alleviate the problems associated with this condition. Pelvic organ prolapse occurs when pelvic organs, such as the bladder, drop from their normal position into the lower part of the pelvis, creating pressure against the vagina and other organs. This change in position can result in a variety of health issues, such as stress incontinence, bowel problems, and difficulty with sex. Pelvic organ prolapsed is most common after childbirth, although women of any age can suffer from this condition.

When transvaginal surgical mesh products were first introduced, it seemed the answer to POP problems had been found. These devices, which were surgically placed in the vagina to correct the prolapsed organs’ position, provided surgeons with a useful tool to combat the condition. Over 200,000 women each year benefitted from the use of these products, and the Bard Avaulta System, manufactured by C. R. Bard, was one of the most popular.

However, the elation over this new surgical system was short-lived. Instead of correcting the problems associated with POP, many women found that they experienced health problems after their surgery, which were directly attributable to the Bard Avaulta System. These side effects included difficulty or pain during sex, undiagnosed vaginal pain, urinary problems such as incontinence and infection, pelvic pain and inflammation, general infections, erosion or hardening of the vaginal mesh, and damage to other organs. In some cases, the effects of the Bard Avaulta System were actually worse than the symptoms of the POP the device was designed to treat.

The case involves the parents of a young boy who are seeking to hold the landlord accountable for injuries inflicted by a tenant's pit bull. A news release issued by Dogsbite.org states that the group filed the brief with a view to "dispel the many myths about pit bulls perpetuated by pit bull advocates and national animal welfare organizations." In this particular case, Solesky v. Tracey, the claims against the dog's owners were discharged in bankruptcy.

Motorcycle Accident Overview

Motorcycle sales have surged in the past few years as the “over 50” crowd has discovered biking as a relaxing and enjoyable hobby to be shared with friends. Unfortunately, this resurgence of interest in bikes has resulted in a more sinister trend: the increase of deaths in motorcycle-related accidents.

Motorcyclists are already at much greater risk than passenger car drivers and riders; death rates as much as 35 times as high for motorcyclists have been recorded in the past few years, according to the National Highway Traffic Safety Administration, or NHTSA.

Some have blamed older motorcycle riders for this increase, stating that reaction time for seniors is too slow to safely manage a bike, on which a rider must be quick to respond to dangers. These people claim that, as the population ages and more people are on motorcycles at more advanced ages, the fatality rates will continue to rise. However, older bikers have countered this argument by pointing to “normalized” scores in which age is not a factor; these figures show that age is not the only thing to contribute to the new fatality figures.

According to NHTSA, the number of drivers killed in an accident involving a motorcycle rose from a low of 55.3 per 100,000 riders in 1997 to 69.33 in 2004. This is an increase of 25% in just seven years; could this really be due to the rising numbers of senior motorcycle drivers, or is there another explanation?
