San Jose DUI Collision Injures Three

Three people were seriously injured in a San Jose car accident, which officials say, was caused by a suspected drunk driver. According to a Bay City News report, the crash occurred early morning on August 29, 2010 on Highway 101 near Metcalf Road. The occupants of two cars, a Mitsubishi and a Toyota, were on the shoulder of the highway trying to fix a flat tire on a Toyota, when 18-year-old Eric Nun, driving a Mercedes, went off the roadway and crashed into the back of the Mitsubishi.

New Rules For Jury Trials In Civil Matters Heard in California Courts

Currently, taking your civil case in front of a jury requires a lot of time and money. Large juries must be selected, and then after the jury is seated, the trial can drag on for days, weeks, or even months. The California legislature hopes to pass a Bill soon that will make jury trials much quicker and less expensive for the parties involved.

Assembly Bill 2284 (AB 2284) is an act that, if passed, will establish the Expedited Jury Trials Act. Currently, all trials heard in civil court are required to be heard in front of a jury of up to 12 people. The new law will require only up to eight jurors. This means it will take less time to get a proper jury seated and ready for trial.

Sacramento Car Accident Injures Five

Five people including two children were injured in a Sacramento car accident after a pickup truck and a minivan crashed on the Interstate 80. California Highway Patrol officials say the accident occurred the morning of August 24, 2010 on the eastbound I-80 between the Watt Avenue and Auburn Boulevard exits. The driver of the pickup truck apparently ran away from the scene of the crash. Officials are still looking for the driver. All five injured victims were in the minivan. The extent of the victims' injuries is not known. An investigation is ongoing.

Financial Abuse of the Elderly

Financial crimes against the elderly generally fall under two categories: fraud committed by strangers, and financial exploitation by relatives and caregivers. This blog will concentrate on financial elder abuse by relatives and caregivers.

Unlike strangers, relatives and caregivers often have a position of trust and an ongoing relationship with the elderly. Financial exploitation can be as follows:

1. borrowing money and not paying it back;
2. denying services or medical care to conserve funds;
3. giving away or selling the elder's possessions without permission;
4. signing or cashing pension or social security checks without permission;
5. misusing ATM or credit cards, or using them without permission;
6. giving away the elder's money to family or friends;

The financial abuser will use deceit, intimidation, emotional abuse, or promises of care.

What the Medical Radiation Safety Act Will Do For Your Family

Last year, Cedars-Sinai Medical Center, and other hospitals across the country, overexposed at least 330 patients to toxic levels of radiation when the hospital’s CT scan machines failed to work properly. Toxic levels of radiation -- in some cases eight times safe levels -- of radiation were forced upon unsuspecting patients who were being treated for various ailments. These extremely high doses of radiation could lead to a lifetime of pain and suffering. This suffering could have been avoided if legislation was in place that required State regulation of the CT scanning machines and the technicians who run them.

Toxic levels of radiation exposure occur in CT scans and MRI machines in hospitals across the country. Cedars-Sinai is not the first hospital to overexpose patients in its care. Senate Bill 1237 (SB 1237) is designed to protect your family from over exposure to radiation if you should ever need a CT scan. This will eliminate another tragedy like the one experienced last year at Cedars-Sinai Medical Center.

Four Killed in Long Beach Car Accident

Jesus Heredia Calixto, 18, and Candice Ann Bustamante, 32, a 16-year-old girl and another 19-year-old man were killed in a violent car accident in Long Beach, which officials say, was caused by two cars racing each other on a public roadway.

The Press Telegram reports that the horrific crash happened on the Long Beach Peninsula the morning of August 22, 2010 when a Ford Mustang and a 1997 Ford Taurus collided. The Mustang then hit a stone marker. All four of the fatally injured victims were occupants of the Mustang. The two teens in the Taurus fled the scene, but were later apprehended. They are expected to be charged with felony hit-and-run and murder.

Fatal Los Angeles Pedestrian Accident

A man, who was fatally injured in a pedestrian accident in the Lakeview Terrace area, has been identified by local authorities as 49-year-old Alberto Sandoval. According to a City News Service report, the fatal collision occurred on Foothill Boulevard when 58-year-old Paula Larene Dautremont lost control of her vehicle, struck a parked truck and then collided with Sandoval. He died as a result of injuries sustained in this crash. No one was cited or arrested pending an official investigation.

Car Accident in Modesto Area Kills Four

Four people, identified as James Donald Anderson, 49, Emma Gabriela Anderson, 44, and Andrew David Anderson, 15, and James Edward Rowell, 40, were killed in a Modesto car accident the evening of August 24, 2010. According to a news report in The Modesto Bee, the fatal crash occurred when a Chevrolet van ran a stop sign at the intersection of East Las Palmas and Elm avenues in Patterson and crashed into a green Ford SUV. The van was northbound on Elm and the SUV was traveling east on Las Palmas. Another passenger in the SUV, 24-year-old James Anderson, sustained major injuries in the crash. Officials are looking into whether alcohol or drugs were involved in this crash.

Man Killed in California Dog Attack

Jerry Yates, 69, was killed in a dog bite incident after he was mauled on his own property by two large pit bulls that belonged to a neighbor. According to an ABC News report, Yates's body was found with large bite marks and torn flesh, the afternoon of August 22, 2010. Authorities say Yates' wounds suggest that he died trying to fight off the dogs. The owner of the dogs, Sheryl Sellers, has been arrested on a single felony charge of allowing vicious animals at large. Officials say she held the dogs in an enclosure, which was clearly inadequate to restrain dogs of that size. Sellers surrendered the pit bulls, which have since been euthanized.

I offer my deepest condolences to the family and friends of Jerry Yates. Apparently, Yates was a Marine Corps veteran who served three combat tours in Vietnam. Tragic! Please keep this grieving family in your thoughts and prayers.

Fatal Santa Barbara Personal Injury Accident Kills Three

A fatal Santa Barbara personal injury accident took the lives of Leonel Leon, 22, Lorena Guadalupe Tellez-Pacheco, and Jaciel Tellez, 8 on August 24, 2010. According to a report in the Santa Maria Times, the truck driver and owner of the big rig, Joaquin Garcia Morales, rented a trailer that he loaded with 26 tons of gravel. As he was driving down a hill on Highway 152, he lost his brakes. The out of control big rig truck eventually came to halt when it collided with a 1,000 square foot wooden home.

The small 50-year-old wooden home was flattened and three of the occupants suffered fatal injuries. One of the families occupants had left the home moments before the devastating big rig crash occurred. In the height of the crash response, there were nine engines, a latter truck, two search and rescue vehicles, a search dog and 10 chief officers.

Is California Protecting the Elderly?

There has been some concern recently that the Attorney General's office has not been aggressively prosecuting elder abuse cases. The San Francisco Examiner reports that prosecution of abuse cases are down under this particular administration from that of the previous Attorney General. In defense of the allegation, Attorney General Brown's office states that the fewer prosecutions are due to the fact that the previous prosecutions had been successful in clearing up a good bit of the abuse problem. They are now concentrating on fraud cases against the MediCal system and saving the State some money.

Fatal Orange County Car Accident Involves Suspected Drunk Driver

Mai Hayakawa, 22, was killed in an Anaheim car accident which involved a suspected drunk driver, The Orange County Register reports. California Highway Patrol officials say that the fatal car crash occurred the night of August 22, 2010 on the southbound 57 Freeway's transition road to the 91 Freeway.

Hayakawa was a passenger in a Toyota Celica driven by 24-year-old Michael Keating, who officials say, was under the influence at the time. The crash occurred when Keating attempted to pass a semi-trailer by driving on the right shoulder of the road. He lost control of the car, went off the roadway and struck a palm tree. Hayakawa was killed. Another female passenger in the Toyota, 22-year-old Alyssa Unruh, sustained non-life-threatening injuries. Keating was arrested on suspicion of felony drunk driving.

Steve Moore a middle aged man with his wife was driving through N59th Avenue. In front of the Waffle House their Corolla came to a halt at a red light in between N59th Avenue and I-10 FWY Phoenix. Within few seconds a car driven by three young boys crashed into the corolla. The car was traveling at high speeds and the young boys were drunk. The seat belt and the air bag saved the man from fatal injuries but his wife was severely injured as the car was damaged.

Calabasas Car Accident Injures Four Bicyclists

Four people were injured in a Calabasas personal injury accident due to an elderly driver. The intersection accident occurred when an 81-year old woman made a left turn in her Audi A4 and collided with Four bicyclists, according to a Los Angeles Times news report. The accident occurred while the elderly driver was traveling westbound on Mulholland Highway approaching Stokes Canyon Road at 7:30 a.m. Three of the riders suffered critical injuries while the forth received minor injuries. The driver of the vehicle was uninjured.

Fatal San Diego Car Accident

Marc William Durham, 65, was fatally injured in a San Diego car accident, which officials say, was caused by a suspected drunk driver. According to a 10news report, the fatal collision occurred the night of August 20, 2010, at the intersection of Camino Del Norte and Carmel Mountain Road in San Diego. Police say a 57-year-old man rear-ended Durham's vehicle, which was stopped at a red light and triggered a chain reaction crash involving several other vehicles. Several others sustained minor injuries. However, Durham was killed in the crash. The man who caused the crash is suspected of driving under the influence. An investigation is ongoing.

Maritime Employers Will Undertake Surveillance of Injured Seamen

Our maritime lawyers want to warn injured seamen of an extremely common practice in the maritime industry. Most maritime employers or marine adjusters will hire private investigators to obtain videotape surveillance of workers who have been injured, often spending tens of thousands of dollars trying to catch their injured workers in a “lie.” Very often this videotape surveillance will begin almost immediately after the worker is injured in an offshore accident. There are at least three reasons that a maritime employer wishes to receive video surveillance tape of an injured offshore worker.

Car Accident in Colusa County Causes Injuries


Jason Booth, 39, the driver of a 1965 Ford truck and his passenger, 33-year-old Guillermo Gutierrez, were injured in a car accident the morning of August 18, 2010, after their vehicle was rear-ended by another vehicle on Highway 20. According to a news report in the Colusa County Sun-Herald, 36-year-old Ruben Medina, who was westbound on Highway 20, crashed into the stopped Ford truck, which was about to make a left turn on O'Hair Road.

California Highway Patrol officials said Booth had fully stopped the truck and had his left turn signal on, but Medina was not able to stop in time to avoid the violent crash. Booth and Gutierrez were transported to a local hospital with non-life-threatening injuries. Medina was uninjured. An investigation is ongoing.

Newport Beach Bicycle Accident Proves Fatal

A man who died nearly two weeks after he was involved in a bicycle accident in Newport Beach has been identified as 65-year-old Dan Crain. The Orange County Register reports that the Irvine man was riding his bike the night of August 3, 2010, southbound on Newport Coast Drive, when a car merged on to the roadway from the 73 Toll Road and struck him. The car's driver was unable to stop in time to avoid hitting the bicyclist. Crain went through several spinal surgeries, but died August 15, 2010.

My heart goes out to everyone who knew and loved Dan Crain. By all accounts, Crain was a much-loved personality in his community and an experienced, avid bicyclist. His loved ones will be in my thoughts and prayers.

Fatal Bicycle Accident in Gardena Involves Hit-and-Run Driver

Authorities in Gardena are looking for a hit-and-run driver, who they say, struck and killed 31-year-old bicyclist Jennifer Costlow, the night of August 13, 2010. The fatal crash claimed the life of Costlow, who was four months pregnant at the time. She was riding a bike with her boyfriend down Normandie Avenue, near Gardena Boulevard, when a dark-colored two-door sedan struck her and took off. Sacramento Car Accident Kills Pedestrian in Crosswalk

Eric Vernon Hayman, 34, was killed in a Sacramento car accident after he was hit by a vehicle while crossing the road the night of August 16, 2010. According to a KXTV news report, the fatal pedestrian collision occurred when Hayman was walking in a crosswalk at the intersection of Elk Grove Boulevard and Waterman Road, in Elk Grove. A Honda Del Sol, traveling south on Waterman, struck him. Hayman was transported to a local hospital where he died from his injuries. Officials say drugs or alcohol were not involved. No arrests were made or citations issued pending an official investigation.

Los Angeles Car Accident Injures Seven

Seven people were injured in a Los Angeles car accident after two cars struck each other on a busy Reseda street. According to a CBS News report, the two cars were traveling north on Louise Avenue the night of August 17, 2010, when one vehicle tried to pass the other. This resulted in the collision. The vehicles then hit the curb, a power pole and then went into the front yard of a home. No one was in the home at the time of the crash. But seven people in both cars including a 5-year-old child were hurt. Three of the seven victims sustained critical injuries. However, everyone is expected to survive. An investigation is ongoing.

New California Law Targets Adults Who Provide Alcohol to Minors

Governor Arnold Schwarzenegger has signed a bill that will effectively add California to the list of states where adults can be held civilly liable if they provide alcohol to minors in social settings, the Associated Press reports. This law, commonly known as "social host liability law," applies to adults who knowingly allow minors to drink alcohol in their home.

Under this law, in addition to facing criminal charges for furnishing alcohol to a minor, the adults involved can also be held civilly liable in situations where alcohol they provided is determined to be the main cause of personal injuries or death. It is illegal in California for anyone under the age of 21 to consume alcohol.

Newport Beach Car Accident Involves Suspected Drunk Driver

Five people were injured in a Newport Beach car accident, which officials say, was caused by a suspected drunk driver. According to a news report in The Daily Pilot, the injury collision occurred when Carol Nadine Quiroz, 18, of Santa Ana, lost control of her 1997 Acura Integra on southbound Newport Boulevard, near Hoag Drive. Quiroz crossed the center median and crashed head-on into a northbound Dodge truck. Quiroz is in critical condition and four others suffered injuries, which are believed to be non-life-threatening. Quiroz will likely face felony drunk driving charges.

Fresno Area Car Accident Leaves Three Dead

Three people were killed and four sustained injuries in a Fresno car accident on Highway 140 the afternoon of August 14, 2010. According to a news report in The Fresno Bee, the deceased victims were identified as Chowchilla residents Deana Smith, 39, Michael Smith, 43, and Sharon Law, a 55-year-old woman from El Portal. Officials say the fatal crash occurred in Mariposa County near Colorado Road when a Ford Bronco driven by 18-year-old Marissa Fuqua, crossed a double yellow line and collided with a Harley Davidson motorcycle and a Ford Escape. The driver and passenger of the motorcycle were killed, as was the driver of the Ford Escape. Fuqua and three passengers in the Bronco were injured.

Pedestrian Accident in San Bernardino Proves Fatal

Authorities have identified a 48-year-old woman who was killed in a pedestrian accident in Twentynine Palms as Sandra Dawn Cox. The San Bernardino County Sun reports that the fatal crash occurred the evening of August 8, 2010 at the intersection of Highway 62 and Encelia Avenue. A 2005 Chrysler driven by 19-year-old Lacey Barker struck Cox as she was crossing Highway 62. Officials are investigating the cause of the accident.

Motorcycle Accident in Long Beach Proves Fatal

A motorcycle accident in Long Beach proved fatal for 23-year-old Edgar Toledo the evening of August 5, 2010. The Press Telegram reports that the fatal motorcycle crash occurred at the intersection of Santa Fe and Columbia Street, when a 2002 Mitsubishi Galant making a left turn on Columbia struck the 2009 Yamaha motorcycle that was traveling south on Santa Fe. Toledo was pronounced dead at the scene. The 21-year-old driver of the Mitsubishi, Miguel Encisco, and three passengers in that vehicle sustained injuries as well.

Car Accident in Visalia Causes Injuries

Five people were injured, one seriously, in a car accident on August 7, 2010 on Highway 46, according to a news report in the Paso Robles Press. The injury collision occurred when Megan M. Lira, who was driving a 2007 Chevy Malibu west on the highway, braked hard to avoid a Chevy pickup truck that had suddenly slowed down in front of her. Lira's Malibu veered across into opposing lanes of traffic. Paul Greidanus, who was driving a Chevy Silverado east on the highway, swerved to stop from hitting the out-of-control car. But he ended up striking the rear of the Malibu.

San Francisco Car Accident Injures Bicyclist

William Brown, 63, sustained serious injuries in a San Francisco car accident after he was struck while riding his bicycle the afternoon of August 9, 2010. The Bay City News reports that Clements Boylan, a 74-year-old man from Freestone, hit Brown when attempting to turn his 1994 Lexus left into a parking lot off River Road in Santa Rosa. Boylan apparently did not see Brown at the time of the collision. Brown was hit and thrown onto the hood of the Lexus. Authorities believe that Brown's bike helmet lessened his injuries.

I am relieved to hear that no one was fatally injured in this bicycle accident. My thoughts and prayers are with William Brown as he recovers from his injuries.

San Francisco Area Car Accident Injures Four

Andrea Christle, 39, sustained major injuries the morning of August 8, 2010 in a San Francisco car accident after another driver made an illegal turn at a street intersection. According to a news report in the Napa Valley Register, 32-year-old Pedro Perez Mota, driving a 2002 Mitsubishi Lancer, turned left against a red arrow at the intersection of Highway 12 and Highway 29, in Napa. The Lancer crashed into Christle's 1997 Jeep Cherokee.

Fatal San Diego Car Accident

Caroline McElhaney, 52, was killed in a San Diego car accident after her vehicle was rear-ended by another driver changing lanes on the 15 Freeway in Escondido. According to a 10news report, a southbound 1999 Dodge Ram changed lanes near Ninth Street, the morning of August 9, 2010, and could not avoid rear-ending McElhaney's Mercedes-Benz, which was stopped for traffic ahead.

The impact from the collision forced the 2001 Mercedes into the back of a Toyota Avalon, which in turn collided with a Toyota Sienna. McElhaney was transported to an area hospital where she was pronounced dead. The drivers of the Avalon and the Sienna, as well as a passenger in the Sienna, all suffered minor injuries. Jackson Redmond, a 28-year-old Colton resident, who was driving the Dodge Ram, was not injured in the crash.

Bicyclist Injured in San Diego Car Accident

Michael Schaffer, a bicyclist, was injured in a San Diego car accident after he was struck by an SUV the evening of August 6, 2010. KGTV San Diego reports that Schaffer was riding his bike across Smilax Road in San Marcos, when a Ford Explorer SUV driven by Charles Martin hit him. The bicyclist was trapped by the hood of the Ford and carried for about 35 feet, before the vehicle stopped. Schaffer has been hospitalized for treatment of head trauma. The accident is currently under investigation and no citations have been issued at this time.

My heart goes out to Michael Schaffer and his family during this difficult time. I hope he did not suffer catastrophic injuries and is able to have a quick and complete recovery.

Man Killed in San Bernardino Car Accident

A man who was fatally injured in a San Bernardino car accident the morning of August 3, 2010, has been identified by officials as 21-year-old Luke Eller. According to a news report in The San Bernardino County Sun, the 2010 Mazda in which Eller was a passenger went out of control on Lone Pine Canyon Road, rolled over and crashed. The driver of the Mazda, 20-year-old Daniel Sigala, left the scene of the crash. Eller, who was partially ejected from the vehicle, was transported to a local hospital where he was pronounced dead. An investigation is ongoing.

I offer my heartfelt sympathies to everyone who knew and loved Luke Eller. Please keep this grieving family in your thoughts and prayers.

Car Accident in Tulare County Injures Police Officer

A DUI collision in Tulare County injured Sheriff's Deputy Benjamin Quintana the morning of August 2, 2010. According to a news report in The Fresno Bee, a 25-year-old man who was traveling east on Avenue 328 near Highway 63 crossed over the center line and slammed head-on into Quintana's police cruiser. Quintana sustained injuries, which were not life-threatening. The other driver was uninjured.

It is indeed fortunate that Quintana was not catastrophically injured in this crash. I wish the police officer the very best for a speedy and complete recovery.

San Francisco Area Car Accident Proves Fatal

One person was killed and three Santa Rosa residents -- Domingo Layata-Mendez, 34, Nahum Avendano, 26, and Ignacio Hernandez-Rubio, 17 -- where injured in a San Francisco car accident, which officials say, was caused by an unlicensed driver who later fled the scene of the crash. According to a CBS News report, the fatal collision occurred the morning of August 3, 2010, when 19-year-old Laureano Tarazas crashed a Chevy Astro van on Guerneville Road in Sonoma County.

All the occupants in the van were employees of Mid-Valley Labor Services of Madera and were on their way to Occidental. Tarazas was later arrested in his home on suspicion of vehicular manslaughter, felony hit-and-run, driving without a license and infliction of great bodily injury.

Prominent Chef Killed in Car Accident

Ted Consoli, a 58-year-old man from Seaside, was killed in a car accident the evening of July 30, 2010. The Monterey Herald reports that Consoli was driving east on Holman Highway in his 2004 BMW Z4, when a 2000 Ford Explorer struck him. The Explorer was heading west when it crossed over to the eastbound lanes and hit Consoli's BMW. After colliding with the BMW, the Ford then crashed into a 2009 Chevrolet Silverado that had been driving behind the BMW.

Thomas Littlefield, the 61-year-old driver of the Ford SUV, told officials that he might have fallen asleep at the wheel. Andrew Kennedy, 32, and Heather Lauren, 33, the occupants of the Silverado, sustained minor to moderate injuries. An investigation is ongoing.

Los Angeles MTA Bus Accident Injures 13

Thirteen people were injured in a bus accident in Los Angeles when a delivery truck collided with a Metropolitan Transportation Authority bus early morning on August 3, 2010. The Associated Press reports the truck crash caused injuries to both drivers and to 11 bus passengers in all. The accident occurred at the intersection of Temple and Hill streets in downtown Los Angeles. An investigation is ongoing and no citations have been issued yet.

San Francisco Bay Area DUI Hit-and-Run Collisions Injure Three

A suspected drunk driver in Contra Costa County caused five car accidents, injuring three people, the morning of August 1, 2010, officials said. According to a Bay City News report, the unlicensed driver, identified as 23-year-old Cainan Schierholtz "went on a rampage" in Danville, striking a bicyclist, pedestrian, truck, a light pole and a Lexus SUV -- not stopping once. The bicyclist sustained abrasions and contusions; the pedestrian and two occupants of the SUV sought their own medical treatment for various injuries; and the driver of the Ford truck was uninjured. Schierholtz has been arrested on four counts of DUI causing bodily harm, three counts of hit-and-run causing personal injury, two counts of hit-and-run property damage and driving without a license.

Riverside Car Accident Causes Major Injuries

Three people were injured, one seriously, in a Riverside car accident after two cars collided at a street intersection. According to a news report in The Press-Enterprise, the injury accident occurred the morning of July 30, 2010, when a 42-year-old woman, who was driving a Kia sedan east on Terrace Drive turned left on to Park Avenue. The Kia then struck a Chevy sedan driven by a 29-year-old man.

Los Angeles Injury Lawyers File Suit against Los Angeles Unified School District

The Los Angeles personal injury lawyers of BISNAR | CHASE announced today that they have filed a personal injury lawsuit against the Los Angeles Unified School District. The lawsuit alleges that 13-year-old Anwar Stetson suffered severe personal injury after amputating two of his fingers in woodworking class. The alleged injury took place while Anwar was operating the jointer -- a power tool used to straighten a board's edge. While operating the machine Anwar amputated portions of two fingers on his left hand sustaining severe mental, physical and emotional pain and suffering, disfigurement, and physical impairment.

Motorcycle Accident in Newport Beach Injures Police Officer

A Newport Beach police officer sustained injuries in a motorcycle accident after he was hit by a vehicle at a local intersection, The Orange County Register reports. The crash happened the morning of July 26, 2010 at the intersection of Ford Road and Newport Hills Drive, when the driver of an Oldsmobile Cutlass turned left in front of the police officer's motorcycle that was northbound on Ford Road. The officer suffered serious injuries, but is expected to survive. An investigation is ongoing.

I'm relieved to hear that this police officer did not suffer any catastrophic injuries here. I pray for his quick and full recovery.
