Wrongful Death Lawsuit Can Be Filed Over Hit-and-Run Culver City Crash
The following is a guest post by the Chicago wrongful death attorneys at Dolan Law Offices:
A 31-year old man was killed early morning on Sunday in a hit-and-run accident along 405 Freeway in Culver City. The crash injured several other people but police authorities have not disclosed the extent of their injuries. California Highway Patrol officers are now trying to locate the owner of the SUV that was involved in this fatal car crash.
As of now, it is still not clear how the accident actually happened. But regardless of what really occurred or who's really responsible for the accident, in California law fleeing the scene of an accident that has resulted to the death or injury of another party is a crime. The California Vehicle Code Section 20001 says "The driver of any vehicle involved in an accident resulting in injury to any person, other than himself or herself, or in the death of any person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004."
Section 20003 requires a driver involved in an accident to provide information such as his or her name, current address, vehicle registration number, and the names of the occupants of the vehicle that he or she is driving, to any traffic or police officer who is at the scene of accident. The driver should also submit the name and address of the owner or driver of the vehicle that he or she has collided with. In this section, a driver is also required to provide reasonable assistance to any person who is injured in the accident.
If no traffic or police officer is present at the scene of the accident, Section 20004 requires the driver to report the accident to the Department of California Highway Patrol or to the nearest office of a duly authorized police authority.
In this Culver City accident, the driver of the SUV has obviously failed to comply with the statutes of the California Vehicle Code. For the sake of the families of the victims, we hope that the driver of the SUV will come forward or will be quickly located.
Even though the driver of the vehicle that has fled the scene of accident has not been located yet, the family members of the 31-year old victim may benefit from immediately consulting with an experienced wrongful death lawyer. A highly competent wrongful death law firm can actually help them find the driver who has fled the accident scene. But if the driver is not found, an attorney can help them explore other options such as filing an insurance claim with the victim's insurance policy, if ever he or she had one.
