Fatal Pedestrian Accident in San Francisco Bay Area

A pedestrian accident in Concord, killed a man near the State Route 242, CBS News report. The accident occurred when a car struck the pedestrian the night of March 24, 2010. The man was taken to an area hospital. He died several hours after the collision. Police have not said how or exactly where the accident occurred, neither has the driver been identified. An investigation is ongoing.

Woman Injured in Fullerton Car Crash

A Fullerton car accident left one woman seriously injured the morning of May 24, 2010, The Orange County Register reports. The injury crash occurred in the 2600 block of Milton Avenue after a Kia Optima and Toyota 4Runner, both traveling west on Milton, struck each other. The driver of the Kia suffered injuries and was taken to a local hospital. Officials are investigating what caused this accident.

I sympathize with the injured victim. I hope she did not suffer any life-threatening injuries in this crash and pray for her successful recovery.

Sailor on Bicycle Killed in San Diego Car Accident

A 27-year-old sailor was killed in a San Diego car accident after his bicycle was hit by a van in Camp Pendleton. According to a news report in the Navy Times, the sailor was riding his bike along Vandergrift Boulevard near the Wire Mountain housing area the evening of May 25, 2010, when he was struck by a van. He was airlifted to a San Diego hospital where he died later that night.

Apparently, this sailor was assigned to the 1st Marine Logistics Group at Pendleton at the time of this fatal accident. The incident is being investigated by the Naval Criminal Investigative Service.

Los Angeles Car Accident Injures Motorcycle Officer

A motorcycle officer was injured in a Los Angeles car accident after a driver attempting a left turn at an intersection struck him and then fled the scene. According to a news report in the Daily Breeze, the Los Angeles County Sheriff's Department deputy was on his way to investigate an earlier non-injury collision involving a Metro bus and a LAPD cruiser in South Los Angeles.

The accident involving motorcycle officer occurred the afternoon of May 25, 2010 on Florence Avenue near San Pedro Street. The deputy was riding his motorcycle west on Florence when a driver turning left collided with him. The driver apparently fled on foot leaving the car behind. The deputy was knocked off his motorcycle and taken to the hospital with injuries. He is, however, expected to survive. The suspect vehicle is described as a green 1999 Toyota SUV.

Possible DUI Collision in Victorville Injures Four

Four people identified as Maria Arzate, 39; Shannon Troy, 20; Jose Vaca, 48; and Rebecca Long, 26, were injured in a San Bernardino car accident in which alcohol may be a factor. According to a news report in The San Bernardino Sun, Vaca was driving north on Highway 395 near Bear Valley Road early morning on May 23, 2010, when he entered opposing traffic lanes and struck a 2008 Toyota Camry head-on.

U.S. Census Worker Injured in Dog Attack

Wendy Soto, 38, a U.S. Census worker sustained serious injuries in a dog bite incident as she was going door-to-door in Coalinga, California. According to a CBS news report, Soto was conducting census interviews the evening of May 17, 2010. She rang the doorbell of a home when a pit bull came out and began biting her repeatedly. The dog attack only stopped when the owner came and pulled the dog away, police said. Soto sustained injuries to her right leg, stomach and hands. Doctors are now apparently waiting for the swelling to reduce before assessing the extent of Soto's injuries. Officials are preparing to hold a hearing in order to determine whether the dog should be classified as "vicious."

Los Angeles Car Accident Kills Pedestrian

Thomas Stout, 66, was killed in a Los Angeles car accident the morning of May 22, 2010 when a car rammed into several parked cars and struck him. The driver of the vehicle, Josef Byron Britt III, has been arrested on suspicion of felony vehicular manslaughter in connection with this incident, according to a news report in the Los Angeles Daily News. Britt was driving a 2000 Chrysler Sebring east on Rinaldi Street when he struck three vehicles parked at the south curb. Stout was loading items into one of the cars and was hit. He was transported to an area hospital where he died. Britt sustained only minor injuries. If you saw this fatal accident, please contact LAPD at 818-644-8115.

Million Dollar Elder Abuse Verdict from Bed Sore Infection

When it comes to the care and protection of the elderly, absolute vigilance is required. If attention laps, something as simple as a bed sore can become infected and even lead to death.

According to the Modesto Bee, Elizabeth Pao and family were awarded $1.1 million dollars for just such an event. Pao’s mother, Frances Tanner, had fallen in March 2005 and broken her hip. Bed sores developed from neglectful care and she was pronounced dead shortly after.

Orange County Girl Injured in Dog Attack

A vicious dog bite incident in Orange County has left a 6-year-old child seriously injured, the Los Angeles Times reports. Police said the mother of the child who was attacked ended up shooting the dangerous dog, described as a pit bull mix or a boxer, the morning of May 19, 2010. The dog attack occurred in the driveway of the girl's Lake Forest home as her mother was coming out of the house with her infant child and 14-year-old son. The girl and her sister were playing outside when the dog pushed her to the ground and started biting her ferociously.

Despite a neighbor's attempt to free the girl from the dog, it was her brother who jumped on the dog and punched it until it let go. The woman took all her children and ran inside with the dog chasing her. The woman then came out with a handgun and shot the dog, which was still in the porch. The dog has apparently been spotted in the neighborhood before displaying violent or hostile behavior. The girl sustained several bites to her face, leg and body. Police are looking for the owner of the dog, which survived the gunshot.

Woman Injured in Orange County Car Accident

A woman was seriously injured in an Orange County car accident after a driver, who officials say was under the influence, struck her and then fled the scene. The Orange County Register reports that the injury collision happened the afternoon of May 14, 2010 at Avenida Pico and El Camino Real in San Clemente. The victim was taken to an area hospital for treatment of her injuries. She is expected to survive. Police are describing the hit-and-run vehicle as a Saab. No one has been taken into custody yet.

Costa Mesa Car Accident Injures Pedestrian

A 56-year-old man was injured in a Costa Mesa car accident after he was struck by a suspected drunk driver early morning on May 20, 2010. According to a news report in The Orange County Register, the man, the driver of a Ford 150, had stepped out of his truck to open the gate of a business, when an Infiniti G35 driven by 27-year-old Jeffrey Scott Marshall struck the pickup truck pushing it into the victim. The collision occurred on Placentia Avenue close to 17th Street. The victim was transported to an area hospital with a head injury. Marshall was arrested on suspicion of driving under the influence. An investigation is ongoing.

Johnson & Johnson Takes Advantage of the Elderly by Paying Kickbacks

According to the suit filed by the federal government, Johnson & Johnson and two of its subsidiaries paid money, in various forms, to the nation's largest pharmacy, Omnicare, which dispenses drugs to the elderly and nursing home patients.

The kickbacks were given "to induce the nursing home pharmacy company to purchase and recommend J&J drugs, including the anti-psychotic drug Risperdal."

Bakersfield Car Accident Kills Motorcyclist

Brock Kleeman, 20, was killed in a Bakersfield car accident after his motorcycle was struck by a van at an intersection. According to an ABC News report, the fatal crash occurred the afternoon of May 18, 2010 at the intersection of Niles and Robinson Street. Bakersfield police officials said Kleeman was traveling west on Niles when a white Ford Aerostar van driven by 33-year-old Calvin Stepney attempted to turn south onto Robinson. The van ended up turning directly into Kleeman's path. Kleeman lost control of his motorcycle colliding with the driver's side of the van. He was transported to a local hospital in critical condition and died later that day. Stepney was uninjured. Police do not believe alcohol or drugs were a factor.

Modesto Car Accident Proves Fatal for Man

Kevin Vigil, 45, was killed in a Modesto car accident after the vehicle in which he was a passenger was struck by a pickup truck on Highway 108 near Knights Ferry. According to a news report in the Union Democrat, Vigil was a passenger in a 1988 Honda Accord driven by 27-year-old Joseph Lopez, the morning of May 13, 2010. Their Honda was struck by a 2001 Chevy S-10 pickup truck driven by 30-year-old Jason Wood. The pickup truck drifted across the double yellow lines and collided head-on with the Honda. Investigators determined that Wood had fallen asleep at the wheel when his vehicle crossed over traffic lanes. Lopez sustained moderate injuries.

DUI Collision in San Bernardino Proves Fatal for 12-year-old Girl

Sandra Ceballos, 12, was killed, and her uncle and her mother, 37-year-old Maria Sigala, were both seriously injured in a San Bernardino car accident caused by a suspected drunk driver. Police say the driver who caused the crash, 21-year-old Alexander Velasco, drove through a stop sign at the intersection of Macy and Mesa streets the night of May 16, 2010 and broadsided a 2004 Kia Optima driven by Sigala. The impact killed Sandra and seriously injured Sigala and her 21-year-old brother. Velasco has been arrested on suspicion of felony drunk driving.

Los Angeles Hit-and-Run Car Accident Kills Man

Eugene Jackson, 33, was killed in a Los Angeles car accident that occurred at a city intersection early morning on May 15, 2010. According to a CBS News report, the fatal car accident happened when a Dodge Durango SUV ran a red light on South Figueroa Street at 135th Street, and sideswiped a blue 2009 Nissan Altima causing it to crash. Jackson, the driver of the Altima, was taken to a local hospital where he died shortly after the incident. Eyewitnesses told police that the driver and passengers of the Durango got out of the vehicle and fled the scene of the accident. LAPD officials say two men and one woman, who were all in the Durango, fled the crash scene on foot. Anyone with information is asked to contact LAPD South Traffic detectives at 1-877-LAPD-24-7.

Costa Mesa Man Killed in Bicycle Accident

An Orange County man who was killed in a bicycle accident in an unincorporated area of Riverside County the afternoon of May 10, 2010, has been identified as 55-year-old Alan Earl Miller. The Daily Pilot reports that Miller was riding his bike on Temescal Canyon Road when the driver of a 2003 Ford SUV veered off the roadway and rear-ended Miller's bicycle. Miller was ejected from his bike and thrown onto the roadway. He died at the scene. The driver of the Ford SUV has been identified as Scott J. Reis, 42. An investigation is ongoing.

Orange County Pedestrian Accident Injures 7-year-old Girl

A 7-year-old girl was seriously injured in an Orange County car accident after she was struck by a vehicle while playing with a friend in front of her Dana Point home. The Orange County Register reports that the injury collision happened near La Paz Avenue and Silver Lantern Street the evening of May 10, 2010. The driver of the pickup or "military-style" truck that hit the girl did not stop and fled the scene of the collision. The child was transported to an area hospital. Newport Beach Car Accident Injures Construction Worker

A construction worker sustained injuries in a Newport Beach car accident after he was hit by a vehicle on Pacific Coast Highway. The Orange County Register reports that the injury collision occurred the morning of May 13, 2010 in the 8800 block of Pacific Coast Highway near the construction area of the El Morro trailer park. California Highway Patrol officials are looking into what caused the accident. The construction worker was airlifted to Mission Hospital's trauma center for treatment.

My heart goes out to this construction worker and his family for what they are going through at this time. Based on this report, his injuries seem to have been quite serious, possibly critical. I hope he did not sustain any catastrophic injuries in this collision and pray that he makes a speedy and complete recovery.

Street Intersection Car Accident in San Francisco Bay Area Injures Two

Two drivers were injured in a San Francisco car accident after a speeding vehicle entered a street intersection and broadsided another the afternoon of May 8, 2010. According to a news report in the Santa Rosa Press Democrat, a blue Subaru Legacy sedan going south on Brookwood Avenue hit a red Jeep at the intersection of Fourth Street, in Santa Rosa. The Jeep flipped at least twice, eyewitnesses said. The Jeep then landed on its side and its hood crushed into the cab. Both, the driver of the Jeep and the Subaru were transported to an area hospital with serious injuries.

Man Killed in San Francisco Bay Area DUI Car Accident

Adam Bajer, 45, was killed and a 35-year-old man seriously injured in a San Francisco car accident after their vehicle was struck by a suspected drunk driver on the I-680, near Fremont. According to a CBS News report, the crash occurred the morning of May 11, 2010 in the southbound lanes of the freeway near Andrade Road, when a pickup driven by 53-year-old Timothy Bartelt veered into another pickup truck. Both pickup trucks went out of control and rolled over. Bajer, the driver of the second pickup truck was ejected from the vehicle and was pronounced dead at the scene. Bajer's passenger, who has only been identified as a relative sustained severe injuries. Bartelt was arrested on suspicion of felony DUI. An investigation is ongoing.

Saturday morning was picture perfect for a walk in beautiful Huntington Beach. This one was for a great cause as well --- a cause that we strongly believe in as personal injury lawyers. The Newport Beach personal injury law firm of BISNAR | CHASE not only participated in the Walk Like MADD 2010 Orange County event on May 8, 2010, but our office also raised more than $13,000 for Mothers Against Drunk Driving. We had excellent participation. A total of 75 employees, family members and friends walked on the BISNAR | CHASE team. I thank all the sponsors and wonderful participants who made this event both memorable and successful for us. We raised $218 just with our dunk tank!

Sacramento Car Accident Proves Fatal for Bicyclist

A bicycle accident near the CSU Sacramento campus the morning of May 2, 2010 left a man in his 40s fatally injured. News10 reports that the fatal collision occurred at the intersection of Carlson Drive and H Street when the bicycle was hit by a minivan. The man on the bicycle sustained severe injuries and died at the scene. The female driver of the minivan was not hurt. An investigation is ongoing.

Pedestrian Accident in North Hollywood Causes Serious Injuries

A hit-and-run collision in North Hollywood seriously injured a pedestrian who was apparently crossing the street. According to a CBS News report, the injury collision happened at the intersection of Laurel Canyon and Chandler boulevards, when the driver of a blue SUV cut off a Toyota Camry. That caused the Camry to swerve and strike a pedestrian. The SUV, however, did not stop and fled the scene of the collision. The pedestrian suffered a broken arm and leg. Garden Grove Car Accident Kills Elderly Pedestrian

An elderly man was killed in a Garden Grove car accident after he was struck by a vehicle while walking in a crosswalk. According to a news report in The Orange County Register, the man was crossing Ward Street near Ballast Avenue in a crosswalk the afternoon of May 5, 2010 when he was hit by a driver traveling north on Ward. Police say another car traveling north on Ward had stopped to allow the pedestrian to cross the street. But a second car failed to stop and ended up striking the pedestrian. The man was pronounced dead at the scene. The driver has not yet been cited or arrested pending an official investigation.

Bicycle Accident in Visalia Leaves Man with Head Injuries

Timothy Rizzo, 49, was seriously injured in a bicycle accident after he was struck by a car as he was riding on Highway 63 the night of May 3, 2010. According to a news report in The Fresno Bee, Rizzo was riding north on the highway, close to Avenue 328, in Visalia, when a Honda Accord driven by 53-year-old Juana Nunez drifted into the highway's right shoulder and struck Rizzo. California Highway Patrol officials say Rizzo sustained major head injuries and was transported to an area hospital for treatment. Nunez and two of her passengers were not injured in this crash. An investigation is ongoing.

My heart goes out to the injured Timothy Rizzo. I hope he did not sustain any catastrophic injuries and wish him the very best for a speedy and complete recovery. He will be in my thoughts and prayers.

Bus Accident in San Jose Injures Six

Six people were injured in a San Jose car accident after a Santa Clara Valley Transportation Authority bus rear-ended a car near a city intersection. According to a Bay City News Service report, the collision occurred the afternoon of May 3, 2010 near the intersection of West San Carlos Street and South Almaden Boulevard. Six passengers from the crowded bus were transported to area hospitals. However, no one sustained life-threatening injuries. No one in the rear-ended vehicle was injured. Authorities have stated that the bus driver will be tested for drugs and alcohol per standard procedure.

One Killed, Four Injured in Los Angeles Car Accident

Lisa Hylla, 25, was killed and five others were injured in a Los Angeles car accident the morning of May 3, 2010. According to a news report in the Los Angeles Daily News, the fatal car crash occurred early morning on the northbound 405 Freeway near Devonshire Street. California Highway Patrol officials said Hylla was driving a 2007 Toyota Scion that was involved in a collision with a 1984 Toyota pickup truck that was occupied by a couple. The pickup truck, driven by a 64-year-old Richmond man, was then struck by a Los Angeles County Sheriff's patrol car occupied by two male deputies. Hylla was thrown into the southbound lanes of traffic. It is still not clear whether Hylla exited her car or if she was ejected from her vehicle.

Three men and one woman were transported to the hospital. The couple sustained moderate injuries while the deputies escaped with minor injuries. The deputies, who were on-duty at the time, were in a marked patrol car at the time and were assigned to the sheriff's Lennox station. An investigation is ongoing.

Bicyclist Killed in Oakland Car Accident

Peter Webster, 60, was killed in an Oakland car accident after he was struck while riding a bicycle at a city intersection. According to a news report in the Oakland Tribune, Webster was riding at the intersection of 52nd and Market streets the evening of April 30, 2010 when he was hit by a Buick driven by a 36-year-old man. The Buick was traveling west on 52nd Street at the time and Webster was riding his bike south on Market Street. Webster was thrown to the pavement and was transported to a local hospital with critical injuries. He died a few hours after the collision. Police are asking anyone who witnessed this accident to call Oakland police at 510-777-8553.

Frivolous Medical Malpractice Lawsuit or Frivolous Defense

What can we do to curtail lawsuit abuse?

If a doctor performs a surgery on the wrong place on a patient and when he discovers his error, admits to his patient that he made an error, does the doctor, the doctor's attorney and the doctor's insurance company then deny any wrongdoing and refuse to compensate the patient for the mistaken surgery? You would certainly think not. The doctor clearly makes an error, does the right thing and admits it to his patient (how could he do anything else since it operated on the wrong portion of the body?), he surely isn't going to deny the facts when it comes to compensating his patient, is he?

San Diego Pedestrian Accident Causes Major Injuries

A San Diego pedestrian accident left one woman seriously injured at a city intersection the morning of April 28, 2010. The San Diego Union-Tribune reports that the injury collision happened at the corner of Second Avenue and Elm Street when the woman was attempting to cross the street. The pedestrian was struck by a Ford Explorer SUV at the intersection. She was taken to a local hospital with hip injuries. Officials are looking into the cause of this accident.

I sympathize with the injured woman and her family. I hope she did not sustain catastrophic injuries and pray that she recovers quickly and completely.

Child Injured in Anaheim School Bus Crash

A child was injured in a bus accident after a school bus and a pickup truck crashed at an Anaheim intersection. The Orange County Register reports that the injury collision occurred the morning of April 23, 2010 at the intersection of Mira Loma Way and Lawrence Avenue. The bus, which was headed to Rio Vista Elementary School with 80 children on board collided with a Toyota Tundra at the intersection. One student was taken to a nearby hospital with injuries. California Highway Patrol officials are investigating the incident.

I hope the child who was hurt in this crash did not suffer major injuries. I wish him or her the very best for a quick and full recovery. It is also fortunate that no one else was injured in this school bus crash.
