San Bernardino Hit-and-Run Car Accident Kills Boy

Kushan Bhandari, a 5-year-old boy was killed and his mother and brother were seriously injured in a San Bernardino car accident when the family was hit crossing a street in Big Bear Lake. According to an Associated Press news report, Sujana Bhandari, the mother, and her two sons--Kushan and 11-year-old Kushal--were crossing Big Bear Boulevard at an intersection the night of July 30, 2009, when they were struck by a sport utility vehicle. The 5-year-old boy was pronounced dead at the scene. The other boy and the mother were airlifted to an area hospital with injuries. Witnesses have described the suspect vehicle as a dark-colored SUV, possibly a dark green Chevy Tahoe.

My heart goes out to the Bhandari family for their tragic, heartbreaking and untimely loss. I offer my deepest sympathies to the family of little Kushan Bhandari, especially to the mother and the older brother who witnessed the pedestrian accident and were themselves badly injured. Brain-Injured San Francisco Bay Area Teen Still in a Coma

A 15-year-old girl remains in a coma after she suffered a traumatic brain injury in a San Francisco Bay Area pedestrian-car accident that happened at the street intersection of Healdsburg Avenue and Florence Avenue on July 3, 2009. According to The Santa Rosa Press Democrat news report, the girl was crossing the downtown Sebastopol street in a crosswalk when she was struck by a car driven by 65-year-old Linda Chilvers. Doctors are now saying that the teenager could be in the hospital for six to eight months at least.

My heart goes out to the family of this teenager, especially her parents. I wish this young girl the very best for a quick and complete recovery, although she probably has a long road ahead. Please keep her in your prayers.

Orange County Pedestrian Accident Injures Woman

Two women were injured in a Garden Grove car accident the night of July 27, 2009 when they were struck by a suspected drunk driver, The Orange County Register reports. The male driver was reportedly traveling west on Westminster Avenue when he struck the two victims, who were crossing the street. One of the women suffered severe injuries including several broken bones. The other woman apparently suffered relatively minor injuries. The driver remained at the scene and was arrested on suspicion of driving under the influence.

I'm relieved that this woman did not suffer catastrophic or life threatening injuries in this car accident. I wish the injured victim the very best for a quick and complete recovery.

Los Angeles County DUI Car Accident Causes Major Personal Injury

Linda Sgaraglino, 58, suffered major injuries in a Los Angeles County car accident reportedly caused by a suspected drunk driver the night of July 26, 2009. According to a news report in the Ventura County Star, 26-year-old Abdula Kwara left a party and caused two hit-and-run car collisions in Simi Valley, California, whose victims followed him in their vehicles. But they both ended up losing sight of him when he fled. Minutes later, Kwara lost control of his car on the eastbound Highway 118 near Tapo Canyon Road, struck the center median and two other vehicles and careened down an embankment. Sgaraglino was an occupant in one of those vehicles that Kwara hit. She suffered major injuries, California Highway Patrol officials said.

Orange County Motorcycle Accident Kills Man

Michael Edwards, 23, of Irvine was killed in an Orange County motorcycle accident the afternoon of July 25, 2009. According to a news report in The Orange County Register, Edwards was riding by himself near Walnut Avenue and Wisteria in Irvine, California, when he collided with a Mercedes Benz. Officials found Edwards lying on the road on Walnut. He was pronounced dead at the scene. The driver of the Mercedes, a 64-year-old man, was taken to a local hospital for treatment. Los Angeles Car Accident Injures Three

Three people suffered injuries in a Los Angeles car accident the afternoon of July 22, 2009 on the 10 Freeway, the San Gabriel Valley Tribune reports. According to California Highway Patrol officials the driver of a 1995 Ford Ranger lost control of the vehicle. The pickup truck rolled over on its side and became fully engulfed in flames on the westbound 10 freeway near Santa Anita Avenue in El Monte, California.

California Personal Injury Lawyers File Lawsuit Against City, School District and SUV Driver For 2008 Death of School Girl

The California personal injury lawyers of Bisnar | Chase have filed a wrongful death and multiple personal injury lawsuit against Walnut Valley Unified School District (WVUSD), the City of Diamond Bar and the driver of an SUV for the 2008 death of a school girl.

The case stems from an incident which occurred on the morning of November 26, 2008 when the accused, Conrad Pantig Maglonzo, negligently and recklessly drove his 1992 Nissan Pathfinder onto a sidewalk, killing three-year old Michelle Kwon and severely injuring Christine and Soonil Kwon.

Tragedy Could Have Been Avoided

"This was a chaotic situation resulting in a tragic car accident that could have been avoided," Los Angeles personal injury lawyer Brian Chase, a partner at Bisnar | Chase said. California DUI Car Accident Leaves Three Dead

Three people--Ricardo Romero-Robles, 21, 12-year-old Christopher Mata and 26-year-old Gabino Romero-Robles--died in a California car accident after their vehicle was struck by a suspected drunk driver. According to an Associated Press news report, the fatal car crash occurred July 18, 2009 on Highway 99 near Fresno when 42-year-old Martin Deleon collided with a Ford Mustang, which in turn struck another vehicle that rolled over. The deceased car accident victims were all occupants of the Ford Mustang. Ricardo Romero-Robles was the driver of the Mustang, California Highway Patrol officials said. Deleon suffered major injuries and will be arrested on suspicion felony drunk driving and gross vehicular manslaughter while under the influence.

My heart goes out to the family and friends of Ricardo and Gabino Romero-Robles and young Christopher--for their tragic and heartbreaking loss. I offer my deepest condolences to this family. Please keep them in your prayers. I also hope that Deleon is prosecuted to the fullest extent of the law.

Driver Error May Have Caused San Francisco Train Accident

All evidence seems to be pointing toward human error in a July 18, 2009 San Francisco Muni train accident that injured 48 people--four seriously--the Associated Press reports. National Transportation Safety Board (NTSB) investigators are trying to determine why the operator of a light rail that crashed into a parked train turned off the automatic controls moments before the train collision. Had the operator kept the autopilot on, federal investigators say, the train would have slowed down before arriving at the West Portal Station and not crashed into the other train. Investigators say they have not found any mechanical problems with the train so far.

Authorities would not identify the driver, but say he started as a San Francisco bus driver 30 years ago and started operating light rail trains about two years ago. He also apparently suffered serious injuries and has taken a drug test as part of Muni's standard procedure. Investigators are also looking into whether the use of a cell phone played a role in this train crash. This is the fourth major subway or commuter train accident in the last 10 months in the United States. Reportedly more than 200 million commuters take San Francisco's mass transit system.

Los Angeles DUI Car Accident Kills Woman

Diana Mendoza, 26, was killed in a Los Angeles car accident after a suspected drunk driver crashed into the stalled car she was in. According to an article in the Whittier Daily News, 20-year-old Criselda Valderrama, who was driving a 1991 Toyota Previa, was arrested on suspicion of vehicular manslaughter while intoxicated after the July 18, 2009 fatal car crash on the northbound 605 Freeway near Washington Boulevard in Whittier. Mendoza and two other women, also 26, were all in a stalled Honda Civic after they crashed into a shoulder guardrail, California Highway Patrol officials said.

Valderrama apparently failed to notice the Honda stopped in the traffic lane and crashed into the rear of the Honda. Mendoza, who was initially driving the Civic, had switched seats with the rear passenger after the initial car crash. The other women in the Honda suffered minor injuries. Valderrama suffered moderate injuries.

San Francisco Muni Metro Train Crash Injures 48

Safety inspectors are looking into what caused a Municipal Railway train accident that injured 48 people--four severely--after one train rear-ended another at the West Portal Station on July 18, 2009, the San Francisco Chronicle reports. The train crash occurred when a L-Taraval train rammed the rear of a K-Ingleside train near the station's boarding platform. The impact from the train collision reportedly shattered the front window of the L train and crumpled its steel nose.

The driver of the L train was the most seriously injured. Three commuters also suffered major injuries, but are said to be in stable condition. Also, 24 people suffered serious injuries and were taken to area hospitals by ambulance. The rest apparently suffered relatively minor injuries. Officials say this is the largest train accident the Municipal Railway has had. Eyewitnesses said they saw many victims suffer head and neck injuries.

One Killed, Several Injured in Los Angeles Car Accident

Maclovia Salinas, 36, was killed in a Los Angeles car accident that also injured a motorcyclist--19-year-old Joseph Ruben Bock--the morning of July 16, 2009. According to a news report in the Inland Valley Daily Bulletin, the car accident occurred on the 10 Freeway near Indian Hill Boulevard in Claremont and involved at least three vehicles--two cars and a motorcycle. California Highway Patrol officials said Salinas died at the scene after a Honda Civic in which she was a passenger was hit by another vehicle moments after it had hit the center divider.

The chain of events began when the Civic, driven by 35-year-old Maurelia Chavez went out of control in the carpool lane, hit the center divider and ended up in the fast lane. The motorcycle driven by Bock collided with the Civic and threw the rider off and onto the roadway. Then, a Toyota 4Runner, driven by 39-year-old Adalberto Vasquez Baez, crashed into the Civic causing Salinas' fatal injuries. Bock sustained hip and knee injuries. Chavez and another passenger in the Civic, 19-year-old Elizabeth Salinas--were also injured.

Fatal SUV Rollover Accident Injures Los Angeles residents

Two people died and six were injured in a three-car rollover car accident in Utah early morning July 12, 2009. According to a news report in The Spectrum, most of the injured victims were from Los Angeles and the Southern California area. The fatal car accident occurred when 29-year-old Juan Garcia, who was driving south on the 15 Freeway, swerved to avoid a deer. Garcia's 1993 Range Rover rolled over several times. His two children--Zapatista Angulo, 3, and Assata Angulo, 5 months, were ejected from the SUV.

The baby--Assata Angulo--died of head injuries. Olegario Angulo, 31, a passenger in the Range Rover, suffered fatal head injuries after the SUV's roof and door caved in. He died at the scene. Chantel Manuel, 22, suffered injuries to the lower torso and Garcia sustained head and arm injuries. Zapatista Angulo was also taken to the hospital with injuries.

Mario Mendez, 67, was driving a 2006 Toyota 4Runner south when he saw the debris, but missed the Range Rover crashing into it. He was not injured. But a third driver, 47-year-old Jennifer Jordan of Rancho Santa Margarita crashed her Toyota Tacoma into the Range Rover and suffered ankle injuries. Her son, Jeremy, 20, suffered minor injuries.

Fatal Lake Havasu Boating Accident

Officials say alcohol was a factor in a deadly boating accident on the Colorado River on July 11, 2009 that killed 23-year-old David Kerber of Moreno Valley and injured seven others. According to a news report in the Inland Valley Daily Bulletin, Kerber was driving his 1999 Lavey Craft powerboat south on the river near the entrance to Lake Havasu, when he tried to pass a 1989 Caribbean powerboat operated by Michael Coleman. Kerber then collided with a northbound 2001 Warlock powerboat operated by Joal Patterson. Kerber's boat was also hit by Coleman's boat, which was unable to avoid the collision.

Kerber was thrown off the boat. A San Bernardino County Sheriff's team recovered his body that was found floating face down in the river. A passenger on Kerber's boat sustained minor injuries. Five passengers on the Warlock were taken to an area hospital with injuries. Patterson sustained internal injuries. A woman aboard the Caribbean suffered head injuries. Sheriff's officials say alcohol was involved, but haven't said which party is suspected of drinking. No arrests have been made yet in this case.

Los Angeles County Car Accident Caused by Drunk Driver Kills Bicycle Rider

Joseph Novotny, 43, was killed in a Los Angeles car accident after he was struck on his bicycle by an alleged drunk driver on Bouquet Canyon Road in the Angeles National Forest, The Signal reports. Two other bicyclists Rigoberto Himenez Jr. and George Munana Jr. sustained injuries that required hospitalization while two other suffered minor injuries. The fatal bicycle accident occurred July 11, 2009 when Marco Valencia, 20, traveling north on Bouquet Canyon, crossed the double yellow lines while making a left turn in the canyon roadway, California Highway Patrol officials said. Valencia's pickup then struck a group of bicyclists including Novotny. After that, he apparently fled the scene of the collision. He also allegedly sideswiped a Hyundai, but the car's driver was uninjured.

Novotny was pronounced dead at the scene. Himenez and Munana were taken to an area hospital. Los Angeles Sheriff's Department officials located Valencia in his 2001 Ford F-150 pickup truck further north along Bouquet Canyon. Valencia is facing several felony charges including murder, driving under the influence causing death and hit-and-run causing death.

Ventura County Fatal Car Accident, DUI Suspected

Thomas Botello, 11, died days after he suffered critical injuries in a Ventura County car accident which officials say was caused by his aunt, Page Germain, an Orange County woman, who was driving under the influence of prescription medication. According to an article in the Ventura County Star, the accident occurred the afternoon of July 4, 2009 at the intersection of Las Posas and Laguna roads near Camarillo. Germain stopped at a stop sign at Las Posas and then continued into the intersection where cross traffic does not have a stop sign. She did not yield right-of-way to a pickup truck driven by 23-year-old Edgar Espinoza who crashed into Germain's sport utility vehicle.

Thomas was sitting in the SUV's right rear seat and was buckled up. He was taken to an area hospital where he died a four days later. A 12-year-old boy in Espinoza's truck also suffered injuries, but they were not life-threatening. Espinoza and another passenger were not injured. Germain of Huntington Beach was arrested on suspicion of driving under the influence of prescription medication.

My heart goes out to the family of Thomas Botello for their tragic and heartbreaking loss. This accident must be especially hard on them because it was caused by another family member. I offer my deepest condolences to Thomas' parents. Please keep them in your prayers. I'm also relieved that Espinoza and the others in the pickup truck were not seriously injured.

San Bernardino Fatal Rollover Car Accident

Robert William Cusack, 47, was killed in a San Bernardino rollover car accident near Highway 395 and Shadow Mountain Road in Adelanto on July 4, 2009, according to a news report in the Victorville Daily Press. Cusack was heading east on Shadow Mountain Road in a black 2007 Toyota Tacoma, when the truck left the roadway and rolled over several times. Cusack was taken to an area hospital where he was pronounced dead shortly after the car crash. California Highway Patrol officials are still trying to determine what caused Cusack's truck to leave the roadway.

According to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS), in 2007, there were three fatalities and 32 injuries involving car accidents in Adelanto. In San Bernardino County, 308 deaths and 9,920 injuries were reported as a result of car accidents in 2007. The National Highway Traffic Safety Administration reports that at least 10,000 fatal traffic accidents in the United States each year involve rollover crashes.

Los Angeles County Bus Accident Injures 14

Fourteen people suffered injuries in a Los Angeles County bus accident after a city bus and a van collided at the intersection of Whittier Boulevard and Concourse Avenue in Montebello on July 6, 2009. According to a news report in the Pasadena Star News, the bus was carrying about 40 passengers. Fourteen of those on the bus, including the bus driver, were taken to area hospitals for treatment of injuries. At least four of those injuries are said to be serious. The driver of the van suffered minor injuries.

It's a relief that this bus accident did not cause life threatening injuries or fatalities. My heart goes out to everybody who was injured in this Los Angeles County bus accident. I wish all the injured victims the very best for a quick and complete recovery.

More Zicam Lawsuits Filed

The California Zicam lawyers at Bisnar | Chase continue to receive inquiries regarding lawsuits and class-action suits about defective over-the-counter Zicam cold medications, which have apparently caused hundreds of Americans to lose their sense of smell and/or taste. These Zicam defective products were meant to relieve cold congestion. However, the defective Zicam nasal cold remedy products clearly have done more harm than good.

Matrixx Initiatives Inc., the manufacturer of the Zicam cold remedies that are believed to be responsible for hundreds of users nationwide losing their sense of smell is expecting to face more Zicam lawsuits, in addition to the ones already filed, after the U.S. Food and Drug Administration warned consumers about Zicam drug effects, according to a Dow Jones news report. Last month, federal officials cautioned consumers to stop using Zicam cold and allergy medications because they can cause permanent loss of smell.

Matrixx officials have said that they are facing a lot of legal action including two economic Zicam class-action lawsuits and a personal injury lawsuit involving 117 plaintiffs. They are now saying that additional Zicam lawsuits involving individual plaintiffs making allegations that its nasal gel products have caused a permanent loss or diminishment of the sense of smell or smell and taste, have been filed. Matirxx officials have also said that they absolutely disagree with the FDA's stance that these drugs are dangerous and defective and that they intend to vigorously defend each and every one of these lawsuits. However, Matrixx has started a formal recall of all of its Zicam Cold Remedy Nasal Gel and Zicam Cold Remedy Nasal Swab products in a move to comply with the FDA's request.

Los Angeles Freeway Car Accident Injures Seven

Seven people were injured, five seriously, in a July 4, 2009 Los Angeles car accident at the 405 Freeway and 101 Freeway interchange, according to a Los Angeles Daily News report. Los Angeles Fire Department officials said five to six cars were involved in the car crash and at least one car rolled over. One person had to be cut free from the wreckage. Officials said seven people were injured, but five who suffered serious personal injury had to be taken to trauma centers in area hospitals. Investigators are looking into what caused this car collision. None of the injured victims was identified.

California Nursing Home Negligence Attorney Warns Consumers about Deficient Facilities

In these times when nursing home abuse and negligence is at an all-time high, it is very important to be armed with pertinent information when you are looking for a nursing home for a loved one. A recent article in U.S. News talks about those nursing homes that are rated as "Special Focus Facility." The truth is there is nothing good or positive about the word "special" here. A Special Focus Facility is basically a nursing home with a history of negligence or consistently substandard results in health inspections - one that has been tagged for extra monitoring and inspections by the federal Centers for Medicare and Medicaid Services as well as the state where it operates. In other words, you want to stay away from these "special" nursing homes.

How does a nursing home gain this dubious status? It doesn't happen with a single health deficiency. For a nursing home to be tagged it would have to have three serious problems at three consecutive inspections. If repeat inspections were necessary because the nursing home did not rectify the problem, that becomes a serious issue as well. According to the Centers for Medicare and Medicaid Services there are about 135 nursing homes on this list. California has six of these homes. Officials say many more nursing homes should be on this list, but aren't because the federal agency simply does not have the resources or the manpower to go after these homes and conduct these inspections.

Being A Juror In A Personal Injury Case: One Man's Jury Experience

Peter Clothier, a friend of mine, recently wrote a heartfelt blog post about his experience serving on a jury to decide on a personal injury case. Needless to say, this blog post, which appeared in Peter's blog, The Buddha Diaries, immediately caught my attention.

Here's a brief description of the case Peter was on the jury for. An 18-year-old man driving a 1992 Honda Accord rear-ended a Mercedes SUV when they were both stopped at a traffic light. The teenager was inattentive and ended up ramming the back of the SUV at 3 to 6 miles an hour. The two drivers exchanged information. A month later, the SUV driver experienced lower back pain. Doctors diagnosed a damaged disk and then it was one thing after another. He underwent three surgeries to repair the disk, tried to get it replaced with an artificial one, which didn't work. In the end, he was in pain, he could no longer work and his relationship broke down. His whole life was falling apart. He filed a personal injury lawsuit against the teenager seeking damages for his injuries, pain and suffering.

This is where Peter's journey began as a juror. In his blog, Peter beautifully and articulately describes the inner struggles that a juror goes through when he or she is sitting there, listening to emotional testimony and grueling details from technical experts (sometimes you wonder if they're speaking English!).

Los Angeles County Car Accident Injures Six

Six people were injured in a Long Beach car accident on the 91 Freeway the morning of July 2, 2009, the Long Beach Press-Telegram reports. The car crash occurred on the eastbound lanes near Paramount Boulevard and involved five cars, one of which caught on fire just after its driver managed to escape from the wreckage. Six suffered injuries -- one critical and one moderate. Four others sustained minor injuries. Four out of the six injured victims were taken to area hospitals. The critically injured driver was expected to survive, Long Beach fire officials said. One motorist had to be extricated from the vehicle. Long Beach traffic investigators are still not sure what caused the car accident or who was at fault.

This car accident could have obviously been a lot worse. I'm relieved no one was catastrophically injured or killed as a result of this fiery collision. I wish all the injured victims the very best for a quick and complete recovery.

According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 39 fatalities and 2,212 injuries were reported in as a result of Long Beach car accidents. In Los Angeles County as a whole, 712 fatalities and 56,475 injuries involving car crashes were reported in 2007.

Driver Who Caused Orange County Car Accident Arrested for DUI

The driver of a pickup, which swerved out of the Express Lanes of the eastbound 91 Freeway and caused a car accident involving at least three other cars, has been arrested on suspicion of driving under the influence. According to an article in The Orange County Register, the car crash occurred the afternoon of July 1, 2009 near Gypsum Canyon Road in Yorba Linda. At least one person was taken to the hospital after the car collision. The pickup being driven by the suspected drunk driver was apparently carrying a load of nails. As the truck rolled over, the nails spilled all over the freeway, California Highway Patrol officials said. No other car accidents were caused by the spilled debris.

My heart goes out to the injured victims in this case who were hurt because of this suspected drunk driver's negligence and recklessness. I wish the injured victims the very best for a speedy and complete recovery.

According to California Highway Patrol's 2007 traffic accident statistics, 178 deaths and 14,185 injuries were reported in Orange County as a result of car crashes. During the same year in Orange County, 75 fatalities and 1,501 injuries involved alcohol-related car crashes.

Orange County Car Accident Critically Injures Good Samaritan

Charles Bybee, 62, of Norwalk suffered critical personal injuries in an Orange County car versus pedestrian accident after he saved an apparently suicidal woman from getting hit by traffic on a Fullerton street, CBS News reports. Eyewitnesses told reporters that Bybee was trying to help the woman out of the middle of a busy street the night of June 29, 2009 where she was trying to get motorists to kill her. Bybee then went back across the street to talk to a police officer when he was hit by a car. The woman was not injured, but Bybee is said to be in critical condition.

My heart goes out to Charles Bybee, who did a brave and noble deed here. Bybee saved a life! Here was a man who genuinely tried to do a good deed and succeeded, but got seriously injured in the process. How tragic! I wish Charles Bybee the very best for a quick and complete recovery. Please keep him in your prayers.
